HomeMy WebLinkAboutRes No 1655PLANNING COMMISSION RESOLUTION NO. 1655 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW ESTABLISHMENT OF A 3204 SQUARE FOOT RESTAURANT IN THE JENSEN'S CENTER AT 73-547 HIGHWAY 111. CASE NO. CUP 94-7 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 5th day of July, 1994, hold a duly noticed public hearing to consider the request of BYJ PARTNERS for approval of a conditional use permit to allow a 3204 square foot restaurant in the C-1 general commercial zone on the south side of Highway 111 east of San Pablo known as 73-547 Highway 111; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project that the project is a Class 3 categorical exemption for purposes of CEQA; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify the granting of said conditional use permit: 1. That a restaurant is a permitted use in the C-1 zone, a parking survey concludes that adequate parking is available to support the proposed use, and the existing center tenants have indicated their approval of the proposed use. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Conditional Use Permit 94-7 is hereby granted for reasons subject to the attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 5th day of July, 1994, by the following vote, to wit: AYES: BEATY, JONATHAN, WHITLOCK, SPIEGEL NOES: NONE ABSENT: NONE ABSTAIN: NONE eOBERT A. CUP 94-7 Department of Community Development: 1. The development of the property shall conform with all approved exhibits on file with the department of community development, to all municipal, state, and federal statutes now in force and which hereafter may be in force. 2. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Review Commission City Fire Marshal Coachella Valley Water District Palm Desert Water and Services District 3. That the restaurant hours shall be 6:00 a.m. until 12:00 midnight daily, Sunday through Thursday, and 2:00 a.m. Friday and Saturday. 4. That the restaurant operator shall contract with Palm Desert Disposal for adequate pick up service in order that food odors do not become a problem. 5. That this restaurant shall not have a drive up service. 2
