A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF PALM DESERT, CALIFORNIA,
APPROVING AN EXCEPTION TO SECTION
25.68.310 (A) OF THE ZONING ORDINANCE TO
ALLOW AN ADDITIONAL FREESTANDING SIGN AT
73-547 HIGHWAY 111 (JENSEN'S SHOPPING
CENTER).
CASE NO. 4341 SA
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 20th day of September, 1994, hold a duly noticed
public hearing to consider the request of B-Y-J PARTNERS (Burger King)
for approval of an exception to Section 25.68.310 (A) of the Zoning
Ordinance to allow an additional freestanding sign at 73-547 Highway
111 (Jensen's shopping center); and
WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Procedure for Implementation of the California
Environmental Quality Act, Resolution No. 80-89," in that the director
of community development has determined that the project will not have
an adverse effect on the environment; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to
be heard, said planning commission did find the following facts and
reasons to exist to justify granting the additional freestanding sign:
1. The sign will not be detrimental to neighboring businesses or
the community in general.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the commission in this case.
2. That approval of 4341 SA is hereby granted, subject to the
attached condition.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 4th day of October, 1994, by
the following vote, to wit:
AYES: BEATY, FERNANDEZ, JONATHAN, WHITLOCK
NOES: SPIEGEL
ABSENT: NONE
ABSTAIN: NONE

CONDITIONS OF APPROVAL
CASE NO. 4341 SA
Department of Community Development:
1. The applicant shall obtain an encroachment permit from the
department of public works prior to issuance of building permits.
