HomeMy WebLinkAboutRes No 1673PLANNING COMMISSION RESOLUTION NO. 1673 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW THE OPERATION OF A 6027 SQUARE FOOT UNIVERSITY FACILITY (CHAPMAN UNIVERSITY), INCLUDING AN ADMINISTRATIVE OFFICE AND CLASSROOMS AT 42-600 COOK STREET IN THE S.I. ZONE. CASE NO. CUP 94-13 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 20th day of December, 1994, hold a duly noticed public hearing to consider the request of H.N. AND FRANCES C. BERGER FOUNDATION for the above mentioned project; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project is a class 3 categorical exemption; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify the granting of said conditional use permit: 1. The proposed location of the conditional use is in accord with the objectives of the zoning ordinance and the purpose of the district in which the site is located. 2. The proposed location of the conditional use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed conditional use will comply with each of the applicable provisions of this title, except for approved variances or adjustments. 4. The proposed conditional use complies with the goals, objectives, and policies of the city's adopted general plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Conditional Use Permit 94-13 is hereby approved, subject to the attached conditions. DIAZ, Sry Palm Desert Planni Commission 2 SABBY JO THAN, Chairperson PLANNING COMMISSION RESOLUTION NO. 1673 CONDITIONS OF APPROVAL CASE NO. CUP 94-13 Department of Community Development: 1. Hours of operation for classes shall be limited from 5:00 p.m. to 10:00 p.m. between September 1st and June 15th with a total enrollment not to exceed 144 students. 2. Overall enrollment for summer classes between the hours of 2:00 p.m. and 6:00 p.m. shall be limited to 30 students. 3. The summer classes between the hours of 2:00 p.m. and 6:00 p.m. shall be reviewed after one summer. 4. The applicant shall develop the adjacent vacant lot (APN 634-141- 012) with parking which meets all city parking standards if the department of community development determines that additional parking is necessary due to the operation of this conditional use permit. 5. Prior to issuance of a certificate of use a restrictive covenant shall be recorded on the adjacent 4.15 acre parcel (APN 634-141- 012) limiting the future use of the lot for parking for Chapman University and shall only be removed by the City of Palm Desert at such a time that the city determines that the parcel's development will not be necessary to mitigate the parking demand caused by this conditional use permit. 3
