A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, DENYING A REQUEST FOR AN
AMENDMENT TO THE TERMS AND CONDITIONS IMPOSED ON
TENTATIVE TRACT NO. 24539 TO PERMIT "LOFT" UNITS WITH A
MAXIMUM HEIGHT OF 22 FEET ON CERTAIN LOTS IN THE SOUTH
PORTION OF TRACT 24539.
CASE NO. TT 24539 AMENDMENT #1
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 6th day of December, 1994, hold a duly noticed
public hearing to consider the request of CENTURY HOMES to permit
"loft" units with a maximum height of 22 feet within certain areas of
TT 24539; and
WHEREAS, the Planning Commission at the conclusion of the December
6, 1994 hearing directed staff to prepare a resolution of denial; and
WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Procedure for Implementation of the California
Environmental Quality Act, Resolution No. 80-89," in that an
Environmental Impact Report was certified February 25, 1988 which
analyzed the impacts of two story apartment units on adjacent
properties among other matters and no further documentation is
necessary; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments of all interested persons desiring to be heard,
said planning commission did find the following facts and reasons to
exist to justify the denial of said requested amendment to Tentative
Tract 24539:
i) That the height of the proposed "loft" units would not be
compatible with existing single story single family units in
the neighborhood.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the commission in this case.
2. That the planning commission does hereby deny the request for
an amendment to the terms and conditions placed on Tentative
Tract Map No. 24539.

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 20th day of December, 1994, by
the following vote, to wit:
AYES: BEATY, FERNANDEZ, SPIEGEL, WHITLOCK, JONATHAN
NOES: NONE
ABSENT: NONE
