HomeMy WebLinkAboutRes No 1685PLANNING COMMISSION RESOLUTION NO. 1685 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A GENERAL PLAN AMENDMENT FROM MEDIUM DENSITY RESIDENTIAL AND CORE AREA COMMERCIAL TO DISTRICT COMMERCIAL AND CERTIFICATION OF A MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT FOR A DISTRICT COMMERCIAL CENTER HAVING UP TO 81,747 SQUARE FEET OF COMMERCIAL USE LOCATED ON 8.7 ACRES AT THE NORTHEAST CORNER OF HIGHWAY 111 AND DEEP CANYON ROAD. CASE NO. GPA 94-2 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 7th day of March, 1995, hold a duly noticed public hearing and continued public hearing on March 21, 1995, to consider the request of F & M ASSOCIATES for approval of the above described project; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of community development has determined that the project as mitigated will not have a significant impact on the environment and a negative declaration has been prepared; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify its actions as described below: 1. District Commercial designation at the proposed location is consistent with the general plan policy of providing convenient neighborhood commercial services at major arterial intersections. 2. The site provides for adequate design buffers to insure compatibility with adjacent land uses. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That the planning commission does hereby recommend approval to the city council of GPA 94-2 Exhibit "A" on file in the department of community development, and a Negative Declaration of Environmental Impact Exhibit "B". NEGATIVE DECLARATION CASE NO: GPA 94-2 APPLICANT/PROJECT SPONSOR: F & M Associates 2041 San Remo Laguna Beach, CA 92651 PROJECT DESCRIPTION/LOCATION: General plan amendment to the land use element from core area commercial and medium density residential to district commercial for an 81,747 square foot retail shopping center on 8.7 acres at the northeast corner of Deep Canyon Road and Highway 111. The Director of the Department of Community Development, City of Palm Desert, California, has found that the described project will not have a significant effect on the environment. A copy of the Initial Study has been attached to document the reasons in support of this finding.
