A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO
THE CITY COUNCIL APPROVAL OF A CHANGE OF ZONE FROM
PC (4) AND PR-5 N S.P. TO PC (2) AND CERTIFICATION
OF A MITIGATED NEGATIVE DECLARATION OF
ENVIRONMENTAL IMPACT FOR A DISTRICT COMMERCIAL
CENTER HAVING UP TO 81,747 SQUARE FEET OF
COMMERCIAL USE LOCATED ON 8.7 ACRES AT THE
NORTHEAST CORNER OF HIGHWAY 111 AND DEEP CANYON
ROAD.
CASE NO. C/Z 94-3
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 7th day of March, 1995, hold a duly noticed
public hearing and continued public hearing on March 21, 1995, to
consider the request of F & M ASSOCIATES for approval of the above
described project; and
WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Procedures to Implement the California
Environmental Quality Act, Resolution No. 80-89", in that the director
of community development has determined that the project as mitigated
will not have a significant impact on the environment and a negative
declaration has been prepared; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard,
said planning commission did find the following facts and reasons to
exist to justify its actions as described below:
1. District Commercial PC (2) zoning will be consistent with the
general plan if the general plan amendment is approved.
2. The site is a sufficient size to support a commercial center
of the size proposed. As well, the site can provide adequate
design buffers to insure compatibility with adjacent uses.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the commission in this case.
2. That the planning commission does hereby recommend approval
to the city council of C/Z 94-3 Exhibit "A" on file in the
department of community development, and a Negative
Declaration of Environmental Impact Exhibit "B".

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 21st, day of March, 1995, by
the following vote, to wit:

California Administrative Code.
NEGATIVE DECLARATION
CASE NO: C/Z 94-3
APPLICANT/PROJECT SPONSOR: F & M Associates

Laguna Beach, CA 92651
PROJECT DESCRIPTION/LOCATION: Change of zone request from PR-5 and PC
(4) to district commercial PC (2) for an 8.7 acre site at the northeast
corner of Highway 111 and Deep Canyon Road for a district commercial
center of up to 81,747 square feet.
The Director of the Department of Community Development, City of Palm
Desert, California, has found that the described project will not have
a significant effect on the environment. A copy of the Initial Study
has been attached to document the reasons in support of this finding.
Mitigation measures, if any, included in the project to avoid
potentially significant effects, may also be found attached.
