HomeMy WebLinkAboutRes No 1689PLANNING COMMISSION RESOLUTION NO. 1689 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A CHANGE OF ZONE FROM PC(4) RESORT COMMERCIAL TO SINGLE FAMILY RESIDENTIAL (PARCELS 640-031-006 THRU 010, 640- 031-015 THRU 019) AND FROM PC(4) RESORT COMMERCIAL TO O.P. OFFICE PROFESSIONAL (640-031-001). ALSO REQUESTED IS A GENERAL PLAN AMENDMENT FROM RESORT COMMERCIAL TO MEDIUM DENSITY RESIDENTIAL (640-031- 006 THRU 010, 640-031-015 THRU 019) AND FROM RESORT COMMERCIAL TO OFFICE PROFESSIONAL (640-031- 001). THESE PARCELS ARE LOCATED WEST OF JOSHUA ROAD BETWEEN CACTUS DRIVE AND PARK VIEW DRIVE. CASE NOS. GPA 95-1, C/Z 95-1 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 2nd day of May, 1995, hold a duly noticed public hearing to consider a request by WILLIAM J. COX and the CITY OF PALM DESERT for approval of the above; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project will not have a significant adverse impact on the environment and a negative declaration has been prepared; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts to justify their actions, as described below: 1. The land use resulting from the change of zone would be compatible with adjacent proposed land uses. 2. The density resulting from the change of zone would be compatible with densities permitted in the adjacent areas. 3. The proposed change of zone would be compatible with the adopted Palm Desert General Plan as amended. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That the planning commission does hereby recommend approval to the city council of GPA 95-1 attached hereto as Exhibit "A", C/Z 95-1 attached hereto as Exhibit "B", and a Negative Declaration of Environmental Impact attached hereto as Exhibit "C". NEGATIVE DECLARATION CASE NOS: C/Z 95-1, GPA 95-1 APPLICANT/PROJECT SPONSOR: William J. Cox P.O. Box 967 Palm Desert, CA 92261 City of Palm Desert PROJECT DESCRIPTION/LOCATION: A change of zone from PC(4) resort commercial to single family residential (parcels 640-031-006 thru 010, 640-031-015 thru 019) and from PC(4) resort commercial to O.P. office professional (640-031-001). Also requested is a general plan amendment from resort commercial to medium density residential (640-031-006 thru 010, 640-031-015 thru 019) and from resort commercial to office professional (640-031-001). These parcels are located west of Joshua Road between Cactus Drive and Park View Drive. The Director of the Department of Community Development, City of Palm Desert, California, has found that the described project will not have a significant effect on the environment. A copy of the Initial Study has been attached to document the reasons in support of this finding.
