A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, APPROVING THE RE -
MAPPING OF THE SOUTHERLY PORTION OF INDIAN RIDGE
COUNTRY CLUB TO CREATE 782 SINGLE FAMILY LOTS PLUS
OTHER COMMON AREA LOTS RATHER THAN THE PREVIOUSLY
APPROVED AIR -SPACE CONDOMINIUM UNITS IN SECTION 11

CASE NO. VESTING TT 28227
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 5th day of September, 1995, hold a duly noticed
public hearing to consider the request of SUNRISE DESERT PARTNERS for
approval of Vesting TT 28227 the re -mapping of the southerly portion of
Indian Ridge Country Club to create 782 single family lots plus other
common area lots rather than the previously approved air -space
condominium units in Section 11 T5S R63; and
WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Procedure for Implementation of the California
Environmental Quality Act, Resolution No. 80-89," in that the director
of community development has determined that the project is
substantially similar to that previously approved under Vesting TT
26123 which was reviewed for compliance with CEQA and no further
documentation is necessary; and
WHEREAS, at said public hearing, upon hearing and considering all
taw testimony and arguments, if any, of all interested persons desiring to
be heard, said planning commission did find the following facts and
reasons to exist to justify approval of said map:
(a) That the proposed map is consistent with applicable general
and specific plans.
(b) That the design or improvement of the proposed subdivision is
consistent with applicable general and specific plans.
(c) That the site is physically suitable for the type of
development (i.e. residential).
(d) That the site is physically suitable for the proposed density
of development.
(e) That the design of the subdivision or the proposed
improvements are not likely to cause substantial
environmental damage or substantially and avoidably injure
fish or wildlife or their habitat.
(f) That the design of the subdivision or the type of
improvements is not likely to cause serious public health
problems.
(g) That the design of the subdivision or the type of
improvements will not conflict with easements, acquired by
the public at large, for access through or use of property
within the proposed subdivision.
PLANNING COMMISSION RESOLUTION NO. 1697
WHEREAS, in the review of this tentative tract map the planning
commission has considered the effect of the contemplated action on the
housing needs of the region for purposes of balancing these needs
against the public service needs of the residents of the City of Palm
Desert and its environs, with available fiscal and environmental
resources.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the commission in this case.
2. That Vesting Tentative Tract Map No. 28227 is hereby approved
for the reasons set forth in this resolution and in the staff
report dated september 5, 1995, and subject to the attached
conditions, Exhibit "A".
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 5th day of September, 1995, by
the following vote, to wit:

ABSENT: CAMPBELL
ABSTAIN: NONE

EXHIBIT "A"
CONDITIONS OF APPROVAL
CASE NO. VESTING TT 28227
Department of Community Development/Planning:
All department of community development/planning conditions applied to
Vesting TT 26123 shall be applicable to this map.
Department of Public Works:
All applicable provisions, conditions and requirements contained within
that certain development agreement between the City of Palm Desert and
Sunrise Desert Partners as approved by the City Council on January 10,
1995, as Ordinance No. 627, as well as City Council Resolutions 90-145
and 90-146 approving Vesting Tentative Map 26123 and Precise Plan 90-
21, shall be considered as conditions of approval for this map.
