A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, APPROVING A
CONDITIONAL USE PERMIT TO ALLOW ESTABLISHMENT OF A
2300 SQUARE FOOT, MAXIMUM 35 SEATS, RESTAURANT IN
THE EAST HALF OF SUITE C AND ALL OF SUITE D OF THE
CENTER AT 73-850 HIGHWAY 111.
CASE NO. CUP 95-13
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 16th day of January, 1996, hold a duly noticed
public hearing to consider the request by JOAN'S BAKERY on behalf of
Chesapeake Bagel Bakery, for approval of a conditional use permit
allowing a 2300 square foot, maximum 35 seats, restaurant on the
property described above; and
WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Procedure for Implementation of the California
Environmental Quality Act, Resolution No. 80-89," in that the director
of community development has determined that the project is a Class 3
categorical exemption for the purposes of CEQA; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to
be heard, said planning commission did find the following facts and
reasons to exist to justify the granting of said conditional use
permit:
1. That a restaurant is a permitted use in the C-1 zone and a
parking survey concludes that adequate parking is available
to support the proposed use.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the commission in this case.
2. That Conditional Use Permit 95-13 is hereby approved subject
to the attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 16th day of January, 1996, by
the following vote, to wit:

NOES: NONE
ABSENT: FERNANDEZ

CONDITIONS OF APPROVAL
CASE NO. CUP 95-13
Department of Community Development:
1. The development of the property shall conform with all approved
exhibits on file with the department of community development, to
all municipal, state, and federal statutes now in force and which
hereafter may be in force.
2. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain
permits and/or clearance from the following agencies:
Riverside County Department of Health
Palm Desert Architectural Review Commission
City Fire Marshal
Coachella Valley Water District
Palm Desert Water and Services District
3. That the restaurant hours shall be 6:00 a.m. until 9:00 p.m.
daily.
4. That the restaurant operator shall contract with Palm Desert
Disposal for adequate pick up service in order that food odors do
not become a problem.
