A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, APPROVING A
CONDITIONAL USE PERMIT TO ALLOW OPERATION OF A 950
SQUARE FOOT CIGAR ROOM WITH BEER, WINE AND SPIRITS
AT 73-405 EL PASEO, SUITE 31A IN THE C-1 S.P.
ZONE.
CASE NO. CUP 96-10
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 19th day of March, 1996, hold a duly noticed
public hearing to consider the request of THE HUMIDOR for approval of
the above; and
WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Procedure for Implementation of the California
Environmental Quality Act, Resolution No. 80-89," in that the director
of community development has determined that the project is a Class 3
categorical exemption for purposes of CEQA; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to
be heard, said planning commission did find the following facts and
reasons to exist to justify the granting of said conditional use
permit:
1. The mix of uses in the complex and the available parking
supplies are such that the proposed cigar room will not
create a parking shortage in the area.
2. The proposed location of the conditional use is in accord
with the objectives of the zoning ordinance and the purpose
of the district in which the site is located.
3. The proposed location of the conditional use and the
conditions under which it will be operated and maintained
will not be detrimental to the public health, safety or
general welfare, or be materially injurious to properties or
improvements in the vicinity.
4. The proposed conditional use will comply with each of the
applicable provisions of this title, except for approved
variances or adjustments.
5. The proposed conditional use complies with the goals,
objectives, and policies of the city's adopted general plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Dessert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the commission in this case.

2. That approval of Conditional Use Permit 96-10 is hereby
granted for reasons subject to the attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 19th day of March, 1996, by
the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. CUP 96-10
Department of Community Development/Planning:
1. Applicant shall comply with all state, county and city regulations
concerning the proposed use.
2. The applicant shall obtain all necessary architectural review
commission and department of building and safety permits required
for any physical modifications of the site.
3. The cigar room shall be limited to a maximum of eight seats.
4. Hours of operation shall be limited to the following:
Monday through Thursday from 10:00 a.m. to 7:00 p.m.
Friday and Saturday from 10:00 a.m. to 10:00 p.m.
Sunday from 11:00 a.m. to 6:00 p.m.
5. Air from the cigar room shall be exhausted to the outside by an
exhaust fan.
6. Air from the cigar room shall not be recirculated to other parts
of the building.
7. No outside entertainment permitted.
