A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, APPROVING A
REQUEST BY VINCENT ROVER ON BEHALF OF FITZHENRY
FUNERAL HOME FOR A CONDITIONAL USE PERMIT TO ALLOW
CONVERSION OF THE MONASTERY TO A FUNERAL HOME IN
AN EXISTING R-3 ZONE AT 44-660 SAN PABLO AVENUE.
CASE NO. CUP 96-11
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 19th day of March, 1996, hold a duly noticed
public hearing to consider the request of VINCENT ROVER ON BEHALF OF
FITZHENRY FUNERAL HOME for approval of a conditional use permit to
allow the conversion of a monastery to a funeral home at an existing
development at 44-660 San Pablo; and
WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Procedure for Implementation of the California
Environmental Quality Act, Resolution No. 95-105," in that the Director
of Community Development has determined that the project is a Class 3
categorical exemption for the purposes of CEQA; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to
be heard, said planning commission did find the following facts and
reasons to exist to justify granting of said conditional use
permit/precise plan:
1. The proposed location of the conditional use is in accord
with the objectives of the zoning ordinance and the purpose
of the district in which the site is located.
2. The proposed location of the conditional use and the
conditions under which it will be operated and maintained
will not be detrimental to the public health, safety or
general welfare, or be materially injurious to properties or
improvements in the vicinity.
3. The proposed conditional use will comply with each of the
applicable provisions of this title, except for approved
variances or adjustments.
4. The proposed conditional use complies with the goals,
objectives, and policies of the city's adopted general plan.
5. The proposed parking lot addition and the conditions under
which the use will be required to operate warrant approval of
the conditional use permit.

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the commission in this case.
2. That approval of Conditional Use Permit 96-11 is hereby
granted for reasons subject to the attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 19th day of March, 1996, by
the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. CUP 96-11
Department of Community Development/Planning:
1. The development of the property shall conform substantially with
exhibits on file with the department of community
development/planning, as modified by the following conditions.
2. Construction of a portion of said project shall commence within
one year from the date of final approval unless an extension of
time is granted; otherwise said approval shall become null, void
and of no effect whatsoever.
3. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all municipal ordinances and state and federal
statutes now in force, or which hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain
permits and/or clearance from the following agencies:
Coachella Valley Water District
Palm Desert Architectural Commission
City Fire Marshal
Public Works Department
Palm Desert Water & Services District
Evidence of said permit or clearance from the above agencies shall
be presented to the department of building and safety at the time
of issuance of a building permit for the use contemplated
herewith.
5. Access to trash/service areas shall be placed so as not to
conflict with parking areas. Said placement shall be approved by
applicable trash company and department of community development.
6. Project is subject to Art in Public Places program per Palm Desert
Municipal Code Chapter 4.10.
7. That the parking lot be designed to comply with the parking lot
tree ordinance.
8. That the parking lot be enclosed on the north and west with a six
(6) foot high masonry wall and that the east side, adjacent to the
street, be enclosed by a 42 inch high masonry wall except for
driveway openings.

9. That when the number of expected guests will exceed the available
self parking spaces the applicant shall provide valet parking.
Valet parking shall be required when the expected number of guests
exceeds 66 persons.
10. That the entrance to/exist from the parking lot be appropriately
signed to direct people to exit south from the parking lot.
11. That services held on site shall be limited to a maximum of 88
expected guests.
Department of Public Works:
1. Drainage fees, in accordance with Section 26.49 of the Palm Desert
Municipal Code and Ordinance No. 653, shall be paid prior to the
issuance of a grading permit (parking lot area only).
2. Any proposed modifications to the existing property access shall
be in accordance with appropriate city standards and
specifications and shall be submitted to the Director of Public
Works for checking approval before construction of any
improvements is commenced.
3. All public/private improvements shall be inspected by the
Department of Public Works and a standard inspection fee shall be
paid prior to issuance of grading permits.
4. In accordance with Palm Desert Municipal Code complete
grading/site improvement plans and specifications shall be
submitted to the Director of Public Works for checking and
approval prior to issuance of any permits.
5. In accordance with Palm Desert Municipal Code Section 3.44 the
project shall be subject to Transportation Uniform Mitigation Fees
(TUMF). The fee shall be based on the proposed change of use in
accordance with the following land use designations:
* Reception/Office, Private Office Office Building
$ 2197.14/1000 S.F.
* Balance of Property Industrial Use
$ 460.02/1000 S.F.
6. Any and all offsite improvements shall be preceded by the approval
of plans and the issuance of valid encroachment permits by the
Department of Public Works.
7. The proposed parking area as shown on the project site plan shall
be redesigned to provide for a longer access throat.
