PLANNING COMMISSION RESOLUTION NO. 1737
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, APPROVING AN
AMENDMENT TO THE PRECISE PLAN OF DESIGN FOR A
8,619 SQUARE FOOT INDUSTRIAL BUILDING LOCATED AT
THE NORTHEAST CORNER OF BOARDWALK AND
MEDITERRANEAN TO PERMIT AN EXISTING ATTIC AREA TO
BE CONVERTED INTO A LIBRARY FOR THE EXCLUSIVE USE
OF THE CURRENT OWNER.
CASE NO. PP 90-12 AMENDMENT #1
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 16th day of April, 1996, hold a duly noticed
public hearing to consider the request of STEPHEN W. ANDERSON for
approval of an amendment to the precise plan for a 8,619 square foot
industrial building located at the northeast corner of Boardwalk and
Mediterranean; and
WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Procedure for Implementation of the California
Environmental Quality Act, Resolution No. 95-105," in that the Director
of Community Development has determined that the requested amendment is
a Class 3 categorical exemption for the purposes of CEQA; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to
be heard, said planning commission did find the following facts and
reasons to exist to justify its actions:
1. The amendment of the precise plan will not substantially
depreciate property values, nor be materially injurious to
properties or improvements in the vicinity.
2. The amendment to the precise plan as conditioned will not
unreasonably interfere with the use or enjoyment of property
in the vicinity by the occupants thereof for lawful purposes.
3. The amendment to the precise plan will not endanger the
public peace, health, safety or general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the commission in this case.
2. That Precise Plan 90-12 Amendment #1 on file in the
Department of Community Development is hereby approved,
subject to attached conditions.

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm gissi
Desert Planning Commission, held on this 16th day of April, 1996, by
the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. PP 90-12 AMENDMENT #1
Department of Community Development:
1. That all previous conditions imposed through Planning Commission
Resolution No. 1452 shall continue in effect.
2. That the applicant/owner enter into an agreement with the city
agreeing to formally designate a minimum of twelve (12) parking
spaces on another site owned by the applicant within 300 feet of
the subject property for use by employees of this building. Said
parking to be applied to this property as long as there are more
than 12 offices in this building. This condition to be recorded
against title of subject property.
3. That the attic area be permitted as a library for the exclusive
use of the current owner only. Any transfer of this right shall
be at the approval of the Planning Commission. This condition to
be recorded on the title of the property so that it would show on
any preliminary title report.
4. That prior to issuance of building permits the applicant provide
staff with the opportunity to view the entire building so that it
(staff) can be assured that the storage areas as designated on the
floor plan are in fact still storage areas.
