HomeMy WebLinkAboutRes No 1749PLANNING COMMISSION RESOLUTION NO. 1749 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT TO A CONDITIONAL USE PERMIT TO ALLOW ALCOHOLICS ANONYMOUS (AA) TO HOLD MEETINGS AT 73- 255 COUNTRY CLUB DRIVE IN THE P ZONE. CASE NO. CUP 01-82 (Amendment No. 3B) WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 4th day of June, 1996, hold a duly noticed public hearing which was continued to July 2, 1996, to consider the request of THE FOUNDATION FOR THE RETARDED OF THE DESERT for the above; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 95-105," in that the Director of Community Development has determined that the project could have an adverse impact on the environment; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify the approval of said conditional use permit amendment: 1. The proposed location of the conditional use is in accord with the objectives of the zoning ordinance and the purpose of the district in which the site is located. 2. The proposed location of the conditional use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed conditional use will comply with each of the applicable provisions of this title, except for approved variances or adjustments. 4. The proposed conditional use complies with the goals, objectives, and policies of the city's adopted general plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Conditional Use Permit 01-82 (Amendment No. 3B) is hereby granted, subject to the attached conditions. CUP 01-82 AMENDMENT NO. 3B Department of Community Development: 1. Parking lot to create at least a total of 96 on -site parking spaces with design of new area to be approved by the Architectural Review Commission. Said parking lot to be complete by December 31, 1996. 2. That Foundation for the Retarded post signs at the driveway exit to Sagewood Drive encouraging vehicles to exit to the north to Country Club Drive. 3. That Alcoholics Anonymous (AA) agree to encourage attendees to park on site when additional parking is provided and to exit to the north to Country Club Drive. 4. That AA shall be limited to a maximum of 96 attendees at any one meeting/session. 5. That AA meetings shall be limited to Sundays and Thursdays only "" and on Sunday shall not commence before 9:00 a.m. and on Thursday shall conclude no later than 9:00 p.m. 6. All new uses of public meeting space at Foundation for the Retarded shall be submitted to the Department of Community Development for review and approval prior to their initiation of use of the facility. If deemed to be similar in nature and no more intensive than previously approved uses, these requests may be approved by the Director of Community Development. If determined by the Director of Community Development to be potentially objective, then said use shall be subject to amendment to this conditional use permit and public hearing before Planning Commission. 7. That all previously imposed conditions relating to CUP 01-82 and amendments to CUP 01-82 shall continue in effect. 3
