HomeMy WebLinkAboutRes No 1755PLANNING COMMISSION RESOLUTION NO. 1755 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A VARIANCE TO INCREASE THE PERMITTED MAXIMUM BUILDING SITE COVERAGE FROM 30 PERCENT TO 37 PERCENT FOR THE R-1 12,000 ZONED LOT LOCATED AT 48-570 OLYMPIC DRIVE, ALSO KNOWN AS LOT 151, TRACT 13008. CASE NO. VAR 96-3 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 2nd day of July, 1996, hold a duly noticed public hearing to consider the request of Robert and Jan Lilac for the above noted variance request for property more particularly described as Lot 151, Tract 13008; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 95-105," in that the Director of Community Development has determined that the project is a Class 5 categorical exemption for the purposes of CEQA; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify approval of said variance: 1. That the plans as presented comply with required setbacks and maximum building height limits. 2. That the plans as presented have been approved by the Summit's Architectural Control Committee. 3. That the plans as presented are consistent with many other existing homes in the Summit. 4. That strict or literal interpretation and enforcement of the specified regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of the ordinance codified in this title. Specifically, revising the plans would impose practical difficulty and a less desirable floor plan layout. 5. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to other properties in the same zone. The lot in question has a depth of 155 feet which is excessive relative to its frontage which permits the extra coverage to be proposed without negatively impacting on the basic zone setbacks. 6. That the granting of the variance or adjustment will not be detrimental to the public health, safety, or welfare, or PLANNING COMMISSION RESOLUTION NO. 1755 materially injurious to properties or improvements in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of VAR 96-3 is hereby granted.
