HomeMy WebLinkAboutRes No 1785PLANNING COMMISSION RESOLUTION NO. 1785 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT FOR AN EIGHTEEN (18) HOLE, 6700 YARD PUBLIC PLAY RESORT GOLF COURSE IN THE SOUTH HALF (1) OF SECTION 4, T5S R6E. CASE NO. CUP 97-1 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 18th day of February, 1997, hold a duly noticed public hearing to consider the request of the CITY OF PALM DESERT REDEVELOPMENT AGENCY for approval of the above mentioned project; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project has been previously assessed as part of the environmental impact report which was prepared by Smith, Peroni and Fox, Planning Consultant, Inc., for development concept plan for Section 4. This application is consistent with the plan evaluated in the EIR and the EIR was certified by the city council November 16, 1994. No further environmental documentation is necessary; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify the granting of said conditional use permit: 1. The proposed location of the conditional use is in accord with the objectives of the zoning ordinance and the purpose of the district in which the site is located. 2. The proposed location of the conditional use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed conditional use will comply with each of the applicable provisions of this title, except for approved variances or adjustments. 4. The proposed conditional use complies with the goals, objectives, and policies of the city's adopted general plan. PLANNING COMMISSION RESOLUTION NO. 1785 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case along with the findings evaluated in the staff report dated February 18, 1997. 2. That approval of Conditional Use Permit 97-1 is hereby granted for reasons subject to the attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 18th day of February, 1997, by the following vote, to wit: AYES: BEATY, CAMPBELL, FERNANDEZ, JONATHAN, FERGUSON NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: PHILIP DRELL, secretary Palm Desert PI. nning Commission 2 J MES CAT • FERGU ON, Chairperson PLANNING COMMISSION RESOLUTION NO. 1785 CONDITIONS OF APPROVAL CASE NO. CUP 97-1 - SOUTH HALF ('/2) SECTION 4 Department of Community Development: 1. Plans shall conform to the plan on file in the department of community development. 2. That the approval granted shall be for an 18 hole 6700 yard golf course. 3. That the proposed golf course shall not be illuminated for night play. 4. That project construction shall comply with SCAQMD Rule 403 and Palm Desert requirements for dust control during grading and construction. Department of Public Works: 1. All applicable provisions, conditions and requirements associated with the Section Four North Sphere Project Environmental Impact Report as certified by the Palm Desert City Council on November 16, 1994, as Resolution No. 94-119, shall be considered as conditions of approval for this project. 2. Design and construction of Country Club Drive street improvements and the proposed main entry road shall be in accordance with applicable city standards. 3
