HomeMy WebLinkAboutRes No 1790PLANNING COMMISSION RESOLUTION NO. 1790 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AMENDMENT ALLOWING NIGHT LIGHTING OF AN EXISTING GOLF DRIVING RANGE AT 74-945 SHERYL AVENUE. CASE NO. CUP 90-6 AMENDMENT WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 4th day of March, 1997, hold a duly noticed public hearing to consider the request of SIMONDS ENTERPRISES for the GOLF CLUB OF PALM DESERT for a conditional use permit • amendment to allow night lighting of an existing driving range at 74-945 Sheryl Avenue; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 97-18," in that the Director of Community Development has determined that the project to be a Class 1 categorical exemption; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify their actions: 1. The proposed lighting plan complies with the requirements of the Palm Desert Outdoor Lighting Ordinance Chapter 24.16 of the Municipal Code which minimizes Tight trespass to adjacent to residential property and the night sky. 2. The location of the golf driving range and manner in which it will be operated will not. be detrimental to the public health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That Conditional Use Permit 90-6 Amendment is hereby approved subject to the attached conditions. PLANNING COMMISSION RESOLUTION NO. 1790 PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 4th day of March, 1997, by the following vote, to wit: AYES: BEATY, CAMPBELL, FERNANDEZ, JONATHAN, FERGUSON NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: PHILIP DRELL, ecretary _ Palm Desert Planning Commission 2 SON, Chairperson PLANNING COMMISSION RESOLUTION NO. 1790 CONDITIONS OF APPROVAL CASE NO. CUP 90-6 AMENDMENT Department of Community Development: 1. The lighting installation and performance shall conform substantially with exhibits on file with the Department of Community Development. 2. Lighting installation, operation and performance shall comply with all requirements of Municipal Code Section 24.16 Outdoor Lighting Requirements including 24.16.060 B4: "4. Outdoor Recreational Facilities for Field Sports. a. The lighting system shall be designed with top shields and "glare control" optic systems to minimize the impact on sky glow and glare to adjacent properties. b. Provide shielding such that the cutoff angle (vertical) to the arc tube above the beam center line (axis) shall be no more than 25 degrees, i.e., the arc tube cannot be directly seen above 25 degrees from the luminaire aiming axis. c. The maximum vertical aiming angle above straight down (nadir) shall be 65 degrees (25 degrees below horizontal). and 24.16.070 Time of Operation 4. Lighting for golf driving ranges shall be off between 10:00 p.m. and sunrise." 3. The applicant shall permit representative of the City access to the driving range to monitor compliance with these conditions. 4. Palm trees, per Architectural Review Commission approval, shall be installed prior to any permits being issued for installation of lights. 3
