HomeMy WebLinkAboutRes No 1793PLANNING COMMISSION RESOLUTION NO. 1793 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND AN AMENDMENT TO A CONDITIONAL USE PERMIT ALLOWING THE TEMPORARY USE OF A FIVE -ACRE PARCEL WEST OF AN EXISTING CHURCH FACILITY TO LOCATE A 6400 SQUARE FOOT CLASSROOM BUILDING AND A 260-SPACE PARKING LOT FOR A PERIOD NOT TO EXCEED 18 MONTHS. CASE NO. CUP 91-8 AMENDMENT WHEREAS, the Planning Commission of the City of Palm Desert, California, did on -the 18th day of March, 1997, hold a duly noticed public hearing to consider the request of the SOUTHWEST COMMUNITY CHURCH for approval of the above mentioned conditional use permit amendment; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 97-18," in that the Director of Community Development has determined that the project will not have a significant adverse impact and a Negative Declaration of Environmental Impact has been prepared; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify the granting of said conditional use permit amendment: 1. The proposed parking lot improvements, temporary classroom and additional conditions of approval are designed to mitigate negative impacts created by the existing church activities. 2. The amendment will allow the church to address neighborhood concerns on an interim basis pending relocation of facility in 18 months. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Conditional Use Permit 91-8 Amendment is hereby granted, subject to the attached conditions. CUP 91-8 AMENDMENT Department of Community Development: 1. The proposed parking lot is to be adequately landscaped to mitigate the visual impact as approved by the Director of Community Development. 2. The proposed parking lot is to be adequately maintained with turf or other dust -free surface. 3. With the exception of one event June 16-20, 1997 between the hours of 9:00 and 11:30 a.m., the subject five -acre parcel shall not be used for any outdoor events. There shall be no amplified music or public address systems used by the church for any outdoor events including at their existing facility at 73-251 Hovley Lane West. 4. Continuation of this approval beyond September 30, 1997 shall be contingent upon initiation of construction and progress toward completion of the Fred Waring facility. 5. The Planning Commission may review this approval at any time if there is evidence of continuing problems involving compliance with or the effectiveness of the conditions. 6. The temporary building shall be removed prior to September 30, 1998. 7. Any permanent or temporary exterior lighting shall comply with the adopted outdoor Palm Desert lighting ordinance and shall be approved by the Director of Community Development. Air conditioning and other mechanical equipment shall be ground mounted on the east side of the building. 9. Outdoor activities occurring on the existing church facility shall cease at 10:00 p.m. Church officials shall maintain supervision until all activity participants leave the property in their vehicles. 10. Project shall pay $600/acre mitigation fee as required by the Coachella Valley Fringe - Toed Lizard Habitat Conservation plan. 3 PLANNING COMMISSION RESOLUTION NO. 1793 EXHIBIT A Pursuant to Title 14, Division 6, Article 6 (commencing with section 15070) of the California Code of Regulations. NEGATIVE DECLARATION CASE NO: CUP 91-8 Amendment • APPLICANT/PROJECT SPONSOR: Southwest Community Church 42-575 Melanie Place, Suite B Palm Desert, CA 92211 PROJECT DESCRIPTION/LOCATION: An amendment to a conditional use permit allowing the temporary use of a five -acre parcel west of an existing church facility to locate a 6400 square foot classroom building and a 260-space parking lot for a period not to exceed 18 months. The Director of the Department of Community Development, City of Palm Desert, California, has found that the described project will not have a significant effect on the environment. A copy of the Initial Study has been attached to document the reasons in support of this finding.
