A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, DENYING A REQUEST BY PALM
SPRINGS BEVERLY ROAD ASSOCIATES FOR A CHANGE OF
ZONE TO APPLY THE FREEWAY COMMERCIAL OVERLAY ZONE
TO ONE OF THE REMAINING VACANT PADS AT THE LUCKY
CENTER AT THE SOUTHWEST CORNER OF WASHINGTON
STREET AND 42ND AVENUE (HOVLEY LANE EAST) IN ORDER TO
PERMIT A JACK IN THE BOX RESTAURANT WITH DRIVE -
THROUGH FACILITY.
CASE NO. C/Z 97-5
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the
6th day of May, 1997, hold a duly noticed public hearing to consider the request of PALM
SPRINGS BEVERLY ASSOCIATES for approval of a change of zone to apply the Freeway
Commercial Overlay Zone to one of the remaining vacant pads at the Lucky Center at the
southwest corner of Washington Street and 42nd Avenue (Hovley Lane East); and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission did
find the following facts and reason to exist to justify denial of said change of zone:
1. The subject property is more than a mile from Interstate 10 and as a result
would not implement the purpose of the Freeway Commercial Overlay Zone
which is to provide for a variety of commercial uses for properties within close
proximity of the Interstate 10 freeway (i.e., provide services to freeway traffic).
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm
Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings of the
commission in this case.
2. That approval of Change of Zone 97-5 is hereby denied without prejudice.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning
Commission, held on this 20th day of May, 1997, by t. ollowing vote, to wit:
