A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT
TO THE EXISTING CONDITIONAL USE PERMIT AT CAM'S
CORNER TO ALLOW CONVERSION OF A 1385 SQUARE FOOT
DELI LIMITED TO A MAXIMUM OF EIGHT SEATS TO A 1385
SQUARE FOOT RESTAURANT WITH UP TO 48 SEATS FOR THE
PROPERTY LOCATED AT THE NORTHWEST CORNER OF
HIGHWAY 1 1 1 AND DEEP CANYON ROAD.
CASE NO. CUP 96-18 AMENDMENT #1
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 16th day of September, 1997, hold a duly noticed public hearing to consider the request
of CAM NEVINS for approval of the above noted amendment; and
WHEREAS, said application has complied with the requirements of the "City of Palm
Desert Procedure for Implementation of the California Environmental Quality Act, Resolution
No. 97-18," in that the Director of Community Development has determined that the
request is a Class 3 categorical exemption for the purposes of CEQA; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission
did find the following facts and reasons to exist to justify the granting of said conditional
use permit amendment:
1. The proposed location of the conditional use amendment is in accord with the
objectives of the zoning ordinance and the purpose of the district in which the
site is located.
2. The proposed location of the conditional use amendment and the conditions
under which it will be operated and maintained will not be detrimental to the
public health, safety or general welfare, or be materially injurious to properties
or improvements in the vicinity.
3. The proposed conditional use amendment will comply with each of the
applicable provisions of this title.
4. The proposed conditional use amendment complies with the goals, objectives,
and policies of the city's adopted general plan.

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm
Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings of
the commission in this case.
2. That CUP 96-18 Amendment #1 is hereby approved, subject to conditions
contained in Exhibit "A" attached.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning
Commission, held on this 16th day of September, 1997, by the following vote, to wit:

EXHIBIT "A"
Department of Community Development:
1. That the maximum number of seats in this restaurant/deli shall be 48 seats.
2. That this restaurant use shall comply with all previous conditions imposed on CUP
96-18.
3. The applicant acknowledges that this approval results in a claim against four of the
eight spaces which are subject to the mutual parking easement. These four spaces
will not be available for further expansion of either project.
