HomeMy WebLinkAboutRes No 1834PLANNING COMMISSION RESOLUTION NO. 1834 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL FOR A CHANGE OF ZONE FROM SINGLE FAMILY (R-2) TO OFFICE PROFESSIONAL FOR SIX PROPERTIES LOCATED ON THE EAST SIDE OF MONTEREY, STARTING FROM SAN GORGONIO WAY AND EXTENDING 360 FEET NORTH. CASE NO. C/Z 97-12 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 21 st day of October, 1997, hold a duly noticed public hearing to consider the above request; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 95-105," in that the Director of Community Development has determined that the Change of Zone will not have a significant negative impact on the environment and a Negative Declaration has been prepared; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify granting approval of said Change of zone and Precise Plan: CHANGE OF ZONE: 1. The proposed change of zone is consistent with the policies of the adopted Palm Desert General Plan. 2. The land use resulting from the change of zone will not substantially depreciate property values nor be materially injurious to properties or improvements in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Change of Zone 97-12 is hereby recommended for reasons subject to the attached conditions. NEGATIVE DECLARATION CASE NO: C/Z 97-12 APPLICANT/PROJECT SPONSOR: City of Palm Desert / Howard Hait 73-510 Fred Waring Drive Palm Desert, CA 92260 PROJECT DESCRIPTION/LOCATION: Change of Zone from Single -Family Residential (R-2) to Office Professional (O.P.) for six properties located on the East side of Monterey, starting from San Gorgonio Way extending 360 feet North. The Director of the Department of Community Development, City of Palm Desert, California, has found that the described project will not have a significant effect on the environment. A copy of the Initial Study has been attached to document the reasons in support of this finding. Mitigation measures, if any, included in the project to avoid potentially significant effects, may also be found attached.
