A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, ESTABLISHING SPECIAL
BUILDING HEIGHT ORIENTATION AND SETBACK STANDARDS
FOR FUTURE DEVELOPMENT OF LOTS 11 AND 14 OF TRACT
28450 WITHIN THE PROJECT COMMONLY KNOWN AS DESERT
WILLOW RESORT.
REBATED CASE NO. PP/CUP 96-28
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 16th day of June, 1998, hold a duly noticed public hearing to consider establishing
special building height orientation and setback standards for future development of Lots 11
and 14 of Tract 28450 within the project commonly known as Desert Willow Resort; and
WHEREAS, said application has complied with the requirements of the "City of Palm
Desert Procedure for Implementation of the California Environmental Quality Act, Resolution
No. 97-18," in that the Director of Community Development has determined that the project
is a Class 4 Categorical Exemption and no further documentation is necessary; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission
did find the following facts and reasons to exist to justify granting approval of said special
standards:
1. The subject development conditions provide for enhanced protection of scenic
views and privacy for adjacent residential property.
2. The development conditions provide for reasonable development of the subject
property consistent with the protection of public peace, health, safety or
general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm
Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings of
the commission in this case.
2. That establishment of special building height orientation and setback standards
for future development of Lots 11 and 14 of Tract 28450 within the project
commonly known as Desert Willow Resort is hereby granted (attached hereto
as Exhibit A).

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning
Commission, held on this 16th day of June, 1998, by the following vote, to wit:

EXHIBIT A
CONDITIONS OF APPROVAL
1. Landscaping along the golf route immediately south of the Montecito property line
will have material and placement that will not unduly impact views.
2. No units shall be parallel to the south boundary of the Montecito development within
three hundred (300) feet of the Montecito residential development.
3. Within four hundred (400) feet of the Montecito development, units shall be no
higher than twenty-four (24) feet above original grade.
4. Prior to submittal of any tentative tract map, development plan, or other city
approval, the prospective developer shall meet with the Montecito Homeowners'
Association to discuss their proposed project.
