HomeMy WebLinkAboutRes No 1869PLANNING COMMISSION RESOLUTION NO. 1869 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A VARIANCE FROM PARKING LOT DEVELOPMENT STANDARDS FOR EIGHTEEN 15 FEET 6 INCHES LONG COMPACT PARKING SPACES TO ALLOW ENLARGEMENT OF TREE WELLS IN CONNECTION WITH THE RELANDSCAPING OF THE TOYS R US PARKING LOT AT 72-314 HIGHWAY 1 1 1. CASE NO. VAR 98-1 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 16th day of June, 1998, hold a duly noticed public hearing to consider the request of TRU PROPERTIES, INC., for the above mentioned variance; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 97-18," in that the Director of Community Development has determined that the project is a Class 4 Categorical Exemption for purposes of CEQA and no further documentation is necessary; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify granting approval of said variance: 1. Strict interpretation of the parking design standards would not allow the creation of adequately sized tree wells preventing compliance with landscape maintenance requirements resulting in unnecessary physical hardship inconsistent with the objectives of the ordinance. 2. The nature of the existing parking lot design and drainage patterns constitute exceptional circumstances which prevent other feasible alternatives. 3. The strict enforcement of the parking design standards would prevent the property from complying with citywide landscape requirements. 4. Adequate full size parking spaces will continue to exist. The reduced length spaces will accommodate the vast majority of automobiles. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. PLANNING COMMISSION RESOLUTION NO. 1869 2. That approval of Variance 98-1 is hereby granted, subject to the attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 16th day of June, 1998, by the following vote, to wit: AYES: FERNANDEZ, FINERTY, CAMPBELL NOES: NONE ABSENT: BEATY, JONATHAN ABSTAIN: NONE „,,Z ONIA M. VAR 98-1 Department of Community Development: 1. The development of the property shall continue to comply with all original conditions contained in Precise Plan 89-21, Resolution 89-125 as modified by this variance represented by the approved revised landscape plan on file in the Department of Community Development prepared by Clark and Company dated April 8, 1998.
