A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, APPROVING AN EXCEPTION
TO THE CITY'S SIGN CODE (SECTION 25.68.300) TO ALLOW
TWO WALL SIGNS ABOVE THE EAVE LINE OF THE BUILDING
AT LOCATED AT 73-125 HIGHWAY 1 1 1, IN THE C-1 S.P.
ZONE.
CASE NO. C 98-9
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 18th day of August, 1998, hold a duly noticed public hearing to consider a request by
CLK, INC. dba CARL'S JR. for the above mentioned, and;
WHEREAS, said application has complied with the requirements of the "City of Palm
Desert Procedure for Implementation of the California Environmental Quality Act, Resolution
No. 97-18," in that the Director of Community Development has determined that the project
is a Class 1 categorical exemption for purposes of CEQA and no further documentation is
necessary; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said planning commission
did find the following facts and reasons to exist to justify granting of the height exception:
A. The signs are integrated into the architecture of the building.
• On July 28, 1998 the Architectural Review Commission found that the signs
to be integrated into the building's special architectural design.
B. The signs will not be detrimental to the neighboring businesses or the
community in general.
The signs will not be detrimental to the surrounding neighbors, since they
comply with sign ordinance and will not exceed 20 feet in height.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm
Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings of
the commission in this case.
2. That approval of C 98-9 is hereby granted, subject to the attached conditions.

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning
Commission, held on this 18th day of August, 1998, by the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. C 98-9
Department of Community Development:
1. The development of the property shall conform substantially with exhibits on file with
the Department of Community Development, as modified by the following conditions.
2. That the signs be individual channel letters, have a three color maximum and comply
with all other provisions of the sign ordinance (Section 25.68).
