HomeMy WebLinkAboutRes No 1888PLANNING COMMISSION RESOLUTION NO. 1888 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF THE GENERAL PLAN AND PREZONING FOR THE PURPOSE OF FUTURE ANNEXATION TO THE CITY OF PROPERTY GENERALLY LOCATED NORTH OF INTERSTATE 10 AND VARNER ROAD, EAST OF WASHINGTON STREET, WEST OF ADAMS STREET AND SOUTH OF FRANCES WAY, AND CERTIFICATION OF AN ADDENDUM TO THE COUNTY OF RIVERSIDE ENVIRONMENTAL IMPACT REPORT AS AMENDED FOR SPECIFIC PLAN NO. 281 AS IT PERTAINS TO THE ABOVE. CASE NOS. GPA 98-5 AND C/Z 98-6 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 18th day of August, 1998, hold a duly noticed public hearing to consider recommending to the City Council approval of the general plan and prezoning for the purpose of future annexation to the city of property generally located north of Interstate 10 and Varner Road, east of Washington Street, west of Adams Street and south of Frances Way, and certification of an addendum to the County of Riverside Environmental Impact Report as amended for Specific Plan No. 281 as it pertains to the above; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 97-18," in that an addendum to the County of Riverside Environmental Impact Report, as amended for Specific Plan No. 281, has been prepared and the Director of Community Development has recommended that it be certified; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify its actions, as described below: 1. The proposed land use designation of low density residential and regional commercial are consistent with the existing County of Riverside land use designations. 2. The proposed prezoning to PR-4 (planned residential four units per acre), PC-3 (regional commercial) and PCD (planned community development overlay) are consistent with the proposed and existing general plan land use designations. 3. The proposed general plan/prezoning will not depreciate property values, restrict the lawful use of adjacent properties or threaten the public health, safety or general welfare. PLANNING COMMISSION RESOLUTION NO. 1888 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That the addendum to the County of Riverside Environmental Impact Report as amended for Specific Plan No. 281 is hereby recommended to the City Council for certification. 3. That the Planning Commission does hereby recommend approval to the City Council of GPA 98-5, C/Z 98-6 as shown on exhibits "A" and "B" respectively attached hereto. 4. That County of Riverside Specific Plan 281 as amended and as conditioned is hereby recommended to the City Council for approval as the master plan of development pursuant to the provisions of Chapter 25.23 of the Municipal Code (Planned Community Development (PCD) overlay zone).
