HomeMy WebLinkAboutRes No 1893PLANNING COMMISSION RESOLUTION NO. 1893 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW ESTABLISHMENT OF A 12,000 SQUARE FOOT CHUCK E. CHEESE'S RESTAURANT AND FAMILY ENTERTAINMENT CENTER INCLUDING 40 TO 60 COIN OPERATED KIDDIE RIDES AND GAMES IN SUITE H OF THE DESERT CROSSING AT 72-513 HIGHWAY 1 1 1 . CASE NO. CUP 98-14 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 15th day of September, 1998, hold a duly noticed public hearing to consider the request of CEC ENTERTAINMENT, INC., for approval of a conditional use permit allowing a 12,000 square foot restaurant on property described above; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 97-18," in that the Director of Community Development has determined that the restaurant use was previously reviewed as part of the Desert Crossing environmental impact report process and that no additional environmental review is necessary; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify the granting of said conditional use permit: 1. That a restaurant and entertainment center with 40 to 60 coin operated kiddie rides and games is a permitted use in the PC-3 zone and the application indicates that sufficient staff will be available to supervise arcade use and avoid loitering outside the business. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Conditional Use Permit 98-14 is hereby approved, subject to the attached conditions. CUP 98-14 Department of Community Development: 1. The development of the property shall conform with all approved exhibits on file with the Department of Community Development, to all municipal, state and federal statutes now in force and which hereafter may be in force. 2. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Review Commission City Fire Marshal Coachella Valley Water District 3. That the restaurant and entertainment center hours shall be 9:00 a.m. until 10:00 p.m. Sunday through Thursday and 9:00 a.m. until 11:00 p.m. on Fridays and Saturdays. 4. That the restaurant operator shall contract with Palm Desert Disposal for adequate pickup service in order that food odors do not become a problem. 5. That the applicant shall employ adequate staff to assure proper supervision of the games arcade. 6. That the applicant shall take necessary steps to assure that loitering outside the business does not become a problem. 7. That the maximum number of rides and games shall not exceed 65. 3
