A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, APPROVING A NEGATIVE
DECLARATION OF ENVIRONMENTAL IMPACT AND
CONDITIONAL USE PERMIT FOR A 12,629 SQUARE FOOT
CHURCH FACILITY ON 4.6 ACRES ON THE WEST SIDE OF
PORTOLA AVENUE, 1600 FEET NORTH OF FRANK SINATRA
DRIVE.
CASE NO. CUP 98-18
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 1st day of December, 1998, hold a duly noticed public hearing to consider the request
of LEWIS BISHOP for PALM DESERT COMMUNITY CHURCH OF CHRIST for approval of a
Negative Declaration of Environmental Impact and conditional use permit for a 12,629
square foot church facility on 4.6 acres on the west side of Portola Avenue, 1600 feet
north of Frank Sinatra Drive; and
WHEREAS, said application has complied with the requirements of the "City of Palm
Desert Procedure for Implementation of the California Environmental Quality Act, Resolution
No. 97-18," in that the Director of Community Development has determined that the project
will not have an adverse impact on the environment and a Negative Declaration has been
prepared; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission
did find the following facts and reasons to exist to justify granting approval of said
conditional use permit:
1. The location of a church fronting on a major secondary street at the periphery
of a residential area is in accord with the objectives of the Planned Residential
zone.
2. The proposed location and conditions under which the church will operate will
not be detrimental to the public health, safety and welfare or be materially
injurious to properties or improvements in the vicinity. Sufficient traffic
capacity and controls exist to insure safe ingress and egress for the facility and
acceptable levels of services at critical intersections.
3. The project as conditioned will comply with all provisions of the Planned
Residential zone.
4. The provision of churches complies with the goals, objectives and policies of
the Palm Desert General Plan.

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm
Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings of
the Commission in this case.
2. That a Negative Declaration of Environmental Impact Exhibit "A" and CUP 98-
18 on file in the Department of Community Development are hereby approved,
subject to conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning
Commission, held on this 1st day of December, 1998, by the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. CUP 98-18
Department of Community Development:
1. That the approval is for the phased development of a 12,629 square foot church
only.
2. That the maximum occupancy of the church shall not exceed 488 persons.
3. Prior to issuance of any permits the applicant shall file a precise plan of design
application for review and obtain approval of same from the Planning Commission.

PROJECT DESCRIPTION/LOCATION: A 12,629 square foot church facility on 4.6 acres
on the west side of Portola Avenue, 1600 feet north of Frank Sinatra Drive.
The Director of the Department of Community Development, City of Palm Desert, California,
has found that the described project will not have a significant effect on the environment.
A copy of the Initial Study has been attached to document the reasons in support of this
finding. Mitigation measures, if any, included in the project to avoid potentially significant
effects, may also be found attached.
