A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, APPROVING AN ADDITIONAL
120 SPACE PARKING LOT SOUTH OF THE PALM DESERT
SOCCER PARK AT THE 42ND AVENUE WESTERLY TERMINUS
AND PERMISSION TO USE A P.A. SYSTEM FOR EMERGENCY
USE.
CASE NO. CUP 96-30 AMENDMENT NO. 1
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 15th day of June, 1999, hold a duly noticed public hearing to consider the request of
the CITY OF PALM DESERT for the above -mentioned project; and
WHEREAS, said application has complied with the requirements of the "City of Palm
Desert Procedure for Implementation of the California Environmental Quality Act, Resolution
No. 97-18," in that the Director of Community Development has determined that the project
will not have a significant adverse effect on the environment and a Negative Declaration of
Environmental Impact has been prepared; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission
did find the following facts and reasons to exist to justify the granting of said conditional
use permit amendment:
1. The proposed location of the conditional use is in accord with the objectives
of the zoning ordinance and the purpose of the district in which the site is
located.
2. The proposed location of the conditional use and the conditions under which
it will be operated and maintained will not be detrimental to the public health,
safety or general welfare, or be materially injurious to properties or
improvements in the vicinity.
3. The proposed conditional use will comply with each of the applicable
provisions of this title, except for approved variances or adjustments.
4. The proposed conditional use complies with the goals, objectives, and policies
of the city's adopted general plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm
Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings of
the commission in this case.

2. That approval of Conditional Use Permit 96-30 Amendment No. 1 is hereby
approved, subject to the attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning
Commission, held on this 15th day of June, 1999, by the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. CUP 96-30 AMENDMENT NO. 1
Department of Community Development:
1. The development of property shall conform substantially with exhibits on file with the
Department of Community Development, as modified by the following conditions.
2. Construction of a portion of said project shall commence within one year from the
date of final approval unless an extension of time is granted; otherwise, said approval
shall become null, void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the restrictions
and limitations set forth herein which are in addition to all municipal ordinances and
state and federal statues now in force, or which hereafter may be in force.
4. Northerly 200 feet of property line along easterly boundary of Portola Country Club
to have eight foot block wall installed prior to completion of parking lot with an
additional 200 feet of eastern boundary of Portola Country Club to have a six foot
high block wall constructed within two years from date of approval.
5. "Emergency Use" of P.A. system defined as lost children, cars blocking fire aisles or
other medical or public safety situations. The P.A. system shall be located within the
secured storage facility. System speakers to be mounted on snack bar.
6. Additional parking lot to be posted to be closed at 9:30 p.m.

Pursuant to Title 14, Division 6, Article 6 (commencing with section 15070) of the
California Code of Regulations.
NEGATIVE DECLARATION
CASE NO: CUP 96-30 AMENDMENT NO. 1
APPLICANT/PROJECT SPONSOR: CITY OF PALM DESERT
PROJECT DESCRIPTION/LOCATION: Additional 120-space parking lot south of the Palm
Desert Soccer Park at the 42nd Avenue westerly terminus and permission to use a P.A.
system for emergency use.
The Director of the Department of Community Development, City of Palm Desert, California,
has found that the described project will not have a significant effect on the environment.
A copy of the Initial Study has been attached to document the reasons in support of this
finding. Mitigation measures, if any, included in the project to avoid potentially significant
effects, may also be found attached.
