A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, DENYING A CONDITIONAL USE
PERMIT BY NICK CONTI FOR A 1,388 SQUARE FOOT
AUTOMOBILE SERVICE BUILDING, OFFICE AND STORAGE ROOM
IN CONJUNCTION WITH AN EXISTING CAR WASH FACILITY
LOCATED AT 73-220 HIGHWAY 111.
CASE NO. CUP 99-6
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the
6th day of July, 1999, hold a duly noticed public hearing to consider the request by NICK
CONTI for the above noted conditional use permit; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission did
find the following facts and reasons to exist to justify denial of said conditional use permit:
1. The project does not provide adequate parking to meet code.
2. The proposed project includes only minor improvements to the existing car wash
facility. If the car wash facility is perpetuated without significant site planning
and aesthetic improvements, it could be materially injurious to properties or
improvements in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm
Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings of the
commission in this case.
2. That Conditional Use Permit 99-6 is hereby denied.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning
Commission, held on this 6th day of July, 1999, by the following vote, to wit:
AYES: CAMPBELL, FINERTY, LOPEZ, BEATY
NOES: NONE
ABSENT: JONATHAN
ABSTAIN: NONE
