HomeMy WebLinkAboutRes No 1951PLANNING COMMISSION RESOLUTION NO. 1951 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING CONDITION NO. 6 OF PLANNING COMMISSION RESOLUTION NO. 1793 EXTENDING LIMITED USE UNTIL JANUARY 1, 2000 OF A METAL BUILDING ASSOCIATED WITH SOUTHWEST COMMUNITY CHURCH LOCATED AT 73-251 HOVLEY LANE WEST. CASE NO. CUP 91-8 AMENDMENT WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 19th day of October, 1999, hold a duly noticed public hearing to consider the request of the SOUTHWEST COMMUNITY CHURCH for approval of the amendment described above; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 97-18," in that the Director of Community Development has determined that the project was previously assessed and no additional documentation is deemed necessary; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning ,Commission did find the following facts and reasons to exist to justify the granting of said conditional use permit amendment: 1. The three month extension of weekend indoor use of the building and the continued limitation on outdoor activities will result in an overall lower level of negative impacts on adjacent neighbors while allowing the church to reasonably maintain their current level of services. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Conditional Use Permit 91-8 Amendment is hereby granted, subject to the attached conditions. CUP 91-8 AMENDMENT Department of Community Development: 1. The proposed parking lot is to be adequately landscaped to mitigate the visual impact as approved by the Director of Community Development. 2. The proposed parking lot is to be adequately maintained with turf or other dust -free surface. 3. With the exception of one event June 16-20, 1997 between the hours of 9:00 and 1 1 :30 a.m., the subject five -acre parcel shall not be used for any outdoor events. There shall be no amplified music or public address systems used by the church for any outdoor events including at their existing facility at 73-251 Hovley Lane West. 4. Continuation of this approval beyond September 30, 1997 shall be contingent upon initiation of construction and progress toward completion of the Fred Waring facility. 5. The Planning Commission may review this approval at any time if there is evidence of continuing problems involving compliance with or the effectiveness of the conditions. 6. (Amended.) Use of the metal building shall be limited to: Saturday - 12:00 p.m. to 8:00 p.m. (adults and children) Sunday - 8:00 a.m. to 6:00 p.m. (adults and children) Monday through Wednesday - 6:00 p.m. to 9:00 p.m. (adults only) Thursday and Friday - No use Activities previously scheduled during time period prohibited by this condition shall be relocated to the main church sanctuary and rescheduled as necessary. All use of the building shall cease on January 2, 2000 and shall not resume until remodeling is completed in connection with CUP 99-7, Planning Commission Resolution No. 1942. 7. Any permanent or temporary exterior lighting shall comply with the adopted outdoor Palm Desert lighting ordinance and shall be approved by the Director of Community Development. 8. Air conditioning and other mechanical equipment shall be ground mounted on the east side of the building. 9. Outdoor activities occurring on the existing church facility shall cease at 10:00 p.m. Church officials shall maintain supervision until all activity participants leave the property in their vehicles. 3 PLANNING COMMISSION RESOLUTION NO. 1951 10. Project shall pay $600/acre mitigation fee as required by the Coachella Valley Fringe - Toed Lizard Habitat Conservation plan. 4
