CASE NOS. PP 94-5 AMENDMENT #1 AND CUP 00-05 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 2nd day of May, 2000, hold a duly noticed public hearing to consider the request of DRS. FRANK AND JANET KERRIGAN for approval of the above mentioned requests; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify denial of said conditional use permit and precise plan amendment: 1. The proposed project will not comply with the current parking standard for medical office buildings and expansion of the proposed building will increase the degree of nonconformity with respect to parking. 2. The applicant's own parking study prepared by a registered professional traffic engineer confirms that the city's parking standard is appropriate. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That CUP 00-05 and PP 94-5 Amendment #1 be denied for the reasons specified above and in the staff report dated May 2, 2000.
