A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT
TO A PRECISE PLAN/CONDITIONAL USE PERMIT FOR THE
REMODEL OF PALMS TO PINES PLAZA EAST, ALSO KNOWN
AS APN 640-170-005, 006 AND 008.
CASE NO. PP/CUP 98-16 AMENDMENT #1
WHEREAS, the City Council of the City of Palm Desert, California, did on the 12th
day of November, 1998, by its Resolution No. 98-139 approve the remodel of the Palms
to Pines East Center; and
WHEREAS, the applicant has requested an amendment to the approved precise plan
of design to revise the site plan to increase the amount of parking from 359 spaces to 410
spaces including 32 compact parking spaces and to increase the permitted building area
from 83,476 square feet to 92,733 square feet (center is currently 89,518 square feet);
and
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 6th day of June, 2000, hold a duly noticed public hearing and continued public hearing
to consider the request of AMERICAN INVESTMENT GROUP/PALM DESERT LLC for
approval of an amendment to the approved precise plan/conditional use permit for Palms to
Pines East; and
WHEREAS, said application has complied with the requirements of the "City of Palm
Desert Procedure for Implementation of the California Environmental Quality Act, Resolution
No. 00-24," in that the Director of Community Development has determined that the project
is a Class 2 categorical exemption for the purposes of CEQA and no further documentation
is necessary; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission
did find the following facts and reasons to exist to justify granting approval of said precise
plan/conditional use permit amendment:
1 . The design of the precise plan amendment will not substantially depreciate
property values, nor be materially injurious to properties or improvements in
the vicinity.
2. The precise plan amendment will not unreasonably interfere with the use or
enjoyment of property in the vicinity by the occupants thereof for lawful
purposes.
3. The precise plan amendment will not endanger the public peace, health, safety
or general welfare.

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm
Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings of
the commission in this case.
2. That approval of Precise Plan/Conditional Use Permit 98-16 Amendment #1
including 32 compact parking spaces is hereby granted, subject to the
attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning
Commission, held on this 6th day of June, 2000, by the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. PP/CUP 98-16
Department of Community Development:
1. That all conditions imposed pursuant to City Council Resolution No. 98-139, except
conditions #10 and #17, shall be applicable to this amendment approval.
