HomeMy WebLinkAboutRes No 2019PLANNING COMMISSION RESOLUTION NO. 2019 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING A REQUEST FOR APPROVAL OF A CONDITIONAL USE PERMIT TO ALLOW THE EXPANSION OF FIRST BAPTIST CHURCH OF PALM DESERT (SPECIFICALLY EXPANSION OF THE PARKING LOT AND CREATION OF AN OUTDOOR RECREATION AREA) ON THE VACANT LOT IMMEDIATELY EAST OF THE EXISTING CHURCH FACILITY AT 43-400 WARNER TRAIL. CASE NO. CUP 00-07 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 5th day of September, 2000, hold a duly noticed public hearing to consider the request of FIRST BAPTIST CHURCH OF PALM DESERT for the above noted conditional use permit; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 00-24," in that the Director of Community Development has determined that the project if approved is a Class 3 categorical exemption for purposes of CEQA and no further documentation is necessary; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify the denial of said conditional use permit: 1. Expansion of the church parking lot and creation of an outdoor recreation area will move noise and light sources closer to existing residential dwellings and as such would be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity. 2. While churches are permitted as conditional uses in the R-E zone district, it is contingent upon the church being complementary and in harmony with the residential community. The proposed parking lot expansion and creation of outdoor recreation area would increase the intensity of use of the site and encourage future expansion beyond that of the current use. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. PLANNING COMMISSION RESOLUTION NO. 2019 2. That approval of Conditional Use Permit 00-07 is hereby denied for reasons specified above.
