A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, DENYING AN AMENDMENT TO THE
GENERAL PLAN FROM MEDIUM DENSITY RESIDENTIAL TO OFFICE
PROFESSIONAL, A CHANGE OF ZONE FROM PR-7 (PLANNED
RESIDENTIAL 7 UNITS PER ACRE) TO O.P. (OFFICE PROFESSIONAL)
A PRECISE PLAN OF DESIGN FOR A 64,521 SQUARE FOOT TWO
STORY PROFESSIONAL OFFICE COMPLEX. A HEIGHT EXCEPTION
(VARIANCE) TO INCREASE THE PERMITTED BUILDING HEIGHT FROM
25 FEET TO 30 FEET AND, A JOINT USE PARKING ARRANGEMENT
WITH THE UNIVERSITY BAPTIST CHURCH ADJACENT TO THE EAST
FOR PROPERTY LOCATED ON THE NORTH SIDE OF FRED WARING
DRIVE, 300 FEET WEST OF FAIRHAVEN DRIVE, 72-600 FRED
WARING DRIVE.
CASE NOS. GPA 00-04, C/Z 00-07, PP 00-1 1 & VAR 00-06
WHEREAS, the Planning Commission of the City of Palm Desert, California, did
on the 17th of October, 2000, hold a duly noticed public hearing to consider the
request of Charlie K. Sweet for approval of the above noted cases; and
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 00-24", in that the Director of Community Development has
determined that if the project is not approved it will not have a significant adverse
impact on the environment and no further environmental review is necessary; and
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments, if any, of all persons desiring to be heard, said Planning Commission
did find the following facts and reasons to exist to justify denial of said request:
1. The precise plan is not consistent with the intent and purpose of the 0.P.
zone district, specifically the lack of onsite parking and excessive building
height.
2. The height variance is not warranted because the applicant can choose
another architectural style which would comply with the height limit.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the Commission in this case.
2. That General Plan Amendment 00-04, Change of Zone 00-07, Precise
Plan 00-1 1, VAR 00-06 and a joint use parking arrangement with the
adjacent property are hereby denied.

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 7th day of November, 2000, by the following vote,
to wit:
