A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, DENYING A CONDITIONAL USE PERMIT
/ PRECISE PLAN OF DESIGN AND DEVELOPMENT AGREEMENT FOR A
23 ROOM RESIDENTIAL CARE FACILITY ON .55 ACRES LOCATED ON
THE WEST SIDE OF SAN RAFAEL AVENUE, 420 FEET NORTH OF SAN
GORGONIO WAY, 44-555 SAN RAFAEL AVENUE.

WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the
17th day of October, 2000, hold a duly noticed public hearing to consider the request of
SCHMITZ ENTERPRISES, INC. and V. CARLOS, for approval of conditional use permit / precise
plan, Developmental Agreement and Negative Declaration of Environmental Impact to allow
construction of a 23 room residential care facility for the elderly on .55 on the west side of
San Rafael Avenue; and
WHEREAS, said application has complied with the requirements of the "City of Palm
Desert Procedure for Implementation of the California Environmental Quality Act, Resolution
No. 00-24," in that the Director of Community Development and a Negative Declaration has
been prepared; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said Planning Commission did find the
following facts and reasons to exist to justify denial of said precise plan:
1. The plan as submitted does not comply with the R-3 or R-3 S.O. zone standards
with respect to room size, required onsite parking and density of development.
2. The project as described by the applicant would not result in significant price
reductions for tenants below that charged by other providers in the city that
have complied with city standards.
3. The proposed architecture Tacks interest and quality.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm
Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings of the
commission in this case.
2. Conditional Use Permit / Precise Plan 00-11 on file in the Department of
Community Development is hereby denied.

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning
Commission, held on this 7th day of November, 2000, by the following vote, to wit:
