HomeMy WebLinkAboutRes No 2034PLANNING COMMISSION RESOLUTION NO. 2034 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT TO AN APPROVED PRECISE PLAN OF DESIGN FOR A RETAIL BUILDING ON THE VACANT LOT AT 73-300 EL PASEO TO INCREASE THE APPROVED SIZE FROM 8,000 SQUARE FEET TO 9,500 SQUARE FEET AND A PARKING VARIANCE OF FIVE SPACES TO ACCOMMODATE THE LARGER BUILDING. CASE NOS. PP 99-17 AMENDMENT #1 AND VAR 00-07 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 5th day of December, 2000, hold a duly noticed public hearing to consider the request of DONALD PECK for the above described project; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 00-24," in that the Director of Community Development has determined that the project was previously reviewed for CEQA compliance and a Negative Declaration was certified and no further review is necessary; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify granting approval of said precise plan as amended and variance: 1. The design of the amended precise plan and the variance requested will not substantially depreciate property values, nor be materially injurious to properties or improvements in the vicinity. 2. The precise plan as amended and the variance requested will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan as amended and the variance requested will not endanger the public peace, health, safety or general welfare. 4. That strict or literal interpretation and enforcement of the specified regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of the ordinance codified in this title as described more fully in the staff report dated December 5, 2000. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to other properties in the same zone as described more fully in the staff report dated December 5, 2000. 6. That strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same vicinity and zone as described more fully in the staff report dated December 5, 2000. 7. That the granting of the variance or adjustment will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity as described more fully in the staff report dated December 5, 2000. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Precise Plan 99-17 Amendment #1 and VAR 00-17 are hereby granted, subject to the attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 5th day of December, 2000, by the following vote, to wit: AYES: CAMPBELL, FINERTY, LOPEZ, BEATY NOES: NONE ABSENT: NONE ABSTAIN: JONATHAN -71 -fig . PP 99-17 AMENDMENT #1 AND VAR 00-07 Department of Community Development: 1. That all conditions imposed in Case No. PP 99-17 shall be conditions of this approval. 3
