HomeMy WebLinkAboutRes No 2076PLANNING COMMISSION RESOLUTION NO. 2076 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, REAFFIRMING AND ADDING CONDITIONS TO ITS PREVIOUS ACTION IN THE MATTER OF CASE NO. PP/CUP 00-27 RECOMMENDING TO CITY COUNCIL APPROVAL OF A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT, MASTER PLAN OF DEVELOPMENT FOR 5.4 ACRES LOCATED ON THE NORTH SIDE OF GERALD FORD DRIVE WEST OF COOK STREET AND A PRECISE PLAN/CONDITIONAL USE PERMIT FOR A THREE-STORY, 88- ROOM HAMPTON INN HOTEL TO BE CONSTRUCTED ON 2.4 ACRES ON THE NORTH SIDE OF GERALD FORD DRIVE APPROXIMATELY 200 FEET WEST OF COOK STREET, 74-900 GERALD FORD DRIVE. CASE NO. PP/CUP 00-27 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 17th day of April, 2001, hold a duly noticed public hearing to consider the request of LAMB ARCHITECTS for approval of the above noted case; and WHEREAS, the Planning Commission did, by its Resolution No. 2063 on April 17, 2001, unanimously (5-0), recommend approval of the application to the City Council; and WHEREAS, the Planning Commission did on the 5th day of June, 2001, consider Case No. PP/CUP 00-27 as referred by the City Council; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 00-24," in that the Director of Community Development has determined that the project will not have a significant adverse impact on the environment and a Negative Declaration of Environmental Impact has been prepared; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify recommending to City Council approval of said request: 1. The master plan and hotel project as designed are consistent with the approved development plan for the area, the General Plan and the Zoning Ordinance. 2. The design of the master plan and precise plan/conditional use permit and the manner in which they will be operated will not substantially depreciate property values, nor be materially injurious to properties or improvements in the vicinity. The master plan and precise plan of design/conditional use permit will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 4. The master plan and precise plan/conditional use permit will not endanger the public peace, health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That the Planning Commission of the City of Palm Desert does hereby reaffirm its previous action in recommending approval of Case No. PP/CUP 00-27 to the City Council per Planning Commission Resolution No. 2063, subject to three (3) additional conditions as shown on Exhibit "A" attached. PP/CUP 00-27 Additional Conditions: 1 . That all perimeter landscaping shall be installed prior to issuance of Certificate of Occupancy for Hampton Inn. If work has not commenced on the gas station and/or restaurant pads by completion of Hampton Inn, those pads shall be seeded with wildflower seeds and irrigated appropriately. 2. That the street and sidewalk improvement plans include provision for a bus stop and shelter on Gerald Ford Drive with architecture complementing the building architecture to the satisfaction of the Director of Community Development. 3. That the proposed street to the west of the restaurant site, Street "A" on PM 30042, be installed north from Gerald Ford Drive to the Hampton Inn access driveway prior to occupancy of the Hampton Inn. 3
