A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, REAFFIRMING APPROVAL OF
A CONDITIONAL USE PERMIT TO ALLOW THE CONVERSION
OF A MOTEL INTO AN OFFICE USE WITH MODI FICATIONS TO
THE CONDITONS OF APPROVAL AS SPECIFIED BELOW. THE
SUBJECT PROPERTY IS LOCATED AT THE NORTHEAST
CORNER OF LARREA STREET AND SAN LUIS REY AVENUE
AND IS REFFERED TO AS 73-768 LARREA STREET AND A.P.N.
627-271-006.

WHEREAS, the Planning Commission of the City of Palm Desert, Califomia, did on the
19th day of June, 2001, hold a duly noticed public hearing to consider the request by
FEDDERLY AND ASSOCIATES for the above noted conditional use permit; and
WHEREAS, said application has complied with the requirements of the "City of Palm
Desert Procedure for Implementation of the Califomia Environmental Quality Act", Resolution
No. 00-24, in that the Director of Community Development has determined that the project was
previously assessed as part of Resolution 1725 and was deemed a Class 3 categorical
exemption for purposes of CEQA and no further documentation is necessary; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission
did find the following facts and reasons to exist to justify the granting of said conditional use
permit:
1. That the existing towers and buildings do not technologically afford the
applicant the ability to provide service to the service area of the applicant or
service provider; and
2. That the geographical boundaries of the proposed service area cannot
technologically be bifurcated to avoid the necessity for a freestanding
tower/antenna at the height proposed; and
3. That the applicant shows compelling technological or economic reason(s) for
requiring a new freestanding facility.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings of the
Planning Commission in this case.
2. That approval of Conditional Use Permit 96-4 is hereby granted for reasons
subject to the modified conditions.

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 19th day of June, 2001, by the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. CUP 96-4
Department of Community Development:
1. The development of the property shall conform substantially with exhibits on file with
the department of community development/planning, as modified by the following
conditions.
2. Condition No. 8 of Resolution 1725 shall be modified to read as follows:
That the applicant obtain a long term lease for use of at least 12 parking spaces from
Union Bank in a location on that site to the satisfaction of the City. The applicant shall
direct all employees to utilize these parking spaces. Said lease to be a period not
less than 10 years, renewable and non -cancelable. Evidence of compliance of this
lease requirement to be filed with the City annually.
3. That the conditional use permit be reviewed at a noticed public hearing before the
Planning Commission prior to July 1, 2004 and least every three -years thereafter.
4. All 18-wheeler truck deliveries to the site shall be prohibited. Deliveries to the site
shall be limited to standards U.P.S . sized trucks.
5. The subject property shall be subject to all conditions specified in Planning
Commission Resolution 1725 unless modified above.
