HomeMy WebLinkAboutRes No 2120PLANNING COMMISSION RESOLUTION NO. 2120 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING A REQUEST FOR APPROVAL OF A PRECISE PLAN / CONDITIONAL USE PERMIT TO ALLOW THE CONSTRUCTION OF A 1,989 SQUARE FOOT CONVENIENCE STORE AND A FUEL STATION LOCATED AT 42-185 WASHINGTON STREET. PROPERTY IS ALSO REFERRED TO AS A.P.N. 637-072-013. CASE NO. PP/CUP 01-28 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 19th day of February, 2002, hold a duly noticed public hearing to a consider a request by HUGH V. JORGENSEN / ALBERTSON'S EXPRESS for the above mentioned; and WHEREAS, at said public hearing, upon hearing and considering aII testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following fact and reason to exist to justify denial of said precise plan/conditional use permit: 1. The high traffic generating fuel station and convenience store will create unacceptable levels of traffic congestion within the shopping center. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, Califomia, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That Precise Plan / Conditional Use Permit 01-28 is hereby denied.
