HomeMy WebLinkAboutRes No 2137PLANNING COMMISSION RESOLUTION NO. 2137 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A NEGATIVE DECLARATION AND PREZONING PART OF SECTION 5, T5S R6E PR-5 (PLANNED RESIDENTIAL, FIVE DWELLING UNITS PER ACRE) TO FACILITATE THE ANNEXATION OF THE PROPERTY TO THE CITY. CASE NO. C/Z 02-03 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 16th day of July, 2002, hold a duly noticed public hearing to consider recommending to City Council approval of a Negative Declaration of Environmental Impact and prezoning part of Section 5, T5S R6E PR-5 (Planned Residential, five dwelling units per acre) to facilitate the annexation of the property to the city; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 02-60," in that the Director of Community Development has determined that the project will not have an adverse impact on the environment and a Negative Declaration has been prepared; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify recommending approval of said prezone and Negative Declaration of Environmental Impact: 1. The proposed prezoning of PR-5 is consistent with the existing land use. 2. The existing land use is consistent with the goals and objectives of the Palm Desert General Plan Land Use Element which designates the property low density residential (3-5 dwelling units per acre). 3. The proposed prezoning will not depreciate property values, restrict the lawful use of adjacent properties or threaten the public health, safety of general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. PLANNING COMMISSION RESOLUTION NO. 2137 2. That the Negative Declaration of Environmental Impact Exhibit "A" and C/Z 02-03 Exhibit "B" attached hereto are hereby recommended to the City Council for approval. NEGATIVE DECLARATION CASE NO: C/Z 02-03 APPLICANT/PROJECT SPONSOR: City of Palm Desert PROJECT DESCRIPTION/LOCATION: Prezoning of part of Section 5, T5S R6E PR-5 to facilitate annexation of the area to the city. The Director of the Department of Community Development, City of Palm Desert, California, has found that the described project will not have a significant effect on the environment. A copy of the Initial Study has been attached to document the reasons in support of this finding. Mitigation measures, if any, included in the project to avoid potentially significant effects, may also be found attached.
