HomeMy WebLinkAboutRes No 2140PLANNING COMMISSION RESOLUTION NO. 2140 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING A VARIANCE REQUEST TO SECTION 25.16.090 TO REDUCE THE REQUIRED SETBACK FOR A FRONT_ENTRY GARAGE FROM TWENTY FEET TO TEN FEET FOR PROPERTY LOCATED AT 74-211 PEPPERGRASS STREET. CASE NO. VAR 02-03 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 16th day of July, 2002, hold a duly noticed public hearing to consider the request by RAYMOND D. MOSER for the above noted variance request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify denial of said variance: 1. The subject property is a 94-foot wide rectangular and level lot that has a rear yard with sufficient room to accommodate construction of the proposed two -car garage while complying with the 20-foot setback required by Section 25.16.090.A.2 of the Zoning Ordinance. 2. There are no exceptional or extraordinary circumstances or conditions applicable to the specific property that do not apply generally to other properties in the same zone or in the nearby area. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That VAR 02-03 is hereby denied.
