A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL
USE PERMIT TO ALLOW WIRED GAMEZ INC., TO OPERATE A
INTERNET AND VIDEO GAMING FACILITY. THE SUBJECT
PROPERTY IS LOCATED AT 73-185 HIGHWAY 111.
CASE NO. CUP 02-29
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the
3rd day of December, 2002, hold a duly noticed public hearing to consider the request by
WIRED GAMEZ INC., for the above noted conditional use permit; and
WHEREAS, said application has complied with the requirements of the "City of Palm
Desert Procedure for Implementation of the California Environmental Quality Act, Resolution
No. 02-60", in that the Director of Community Development has determined that the project is a
Class 3 categorical exemption for purposes of CEQA and no further documentation is
necessary; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission
did find the following facts and reasons to exist to justify the granting of said conditional use
permit:
1 That proposed business is permitted with approval of conditional use permit by
the Planning Commission.
2. That proposed location of the conditional use and the conditions under which it
will be operated or maintained will not be detrimental to the public health, safety
or welfare.
3. That the conditional use permit as conditioned will comply with the zoning
requirements for that district.
4. The proposed business use is compatible with other surrounding uses and
meets all of the City's goals, objectives and policies of the General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings of the
Commission in this case.
2. That approval of Conditional Use Permit 02-29 is hereby granted, subject to the
attached conditions.

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on the 3' day of December, 2002, by the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. CUP 02-29
Department of Community Development:
1. The development of the property shall conform substantially with exhibits on file with
the department of community development/planning, as modified by the following
conditions.
2. The development of the property described herein shall be subject to the restrictions
and limitations set forth herein which are in addition to all municipal ordinances and
state and federal statutes now in force, or which hereafter may be in force.
3. The applicant shall operate his business between the hours of 8 a.m. to 1 a.m.
Sunday through Thursday and 8:00 a.m. to 3:00 a.m. Friday and Saturday. After 6
months the applicant may request an amendment to this Conditional Use Permit, at
that time the project will be reevaluated for a public hearing.
4. Camera tapes should be kept for a minimum of 30 days before being recorded over.
5. After the first 6-months of operation the Police Department may require additional
security measures based on a review of calls for service generated by the project.
6. Applicant shall institute procedures to insure enforcement of the City's curfew
ordinance.
