HomeMy WebLinkAboutRes No 2175PLANNING COMMISSION RESOLUTION NO. 2175 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING A CONDITIONAL USE PERMIT FOR A 3,500 SQUARE FOOT CHURCH LOCATED AT 77-577 MOUNTp1.N VIEW IN THE R.E. 40,000 ZONE. CASE NO. CUP 02-25 WHEREAS, the Planning Commission of the City of Palm Desert, Califomia, did on the 19th day of November, 2002, hold a duly noticed public hearing that, which was continued to December 3`d, 2002, to consider the request by UNITED CHURCH OF THE DESERT for the above mentioned application; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 02-60," in that the Director of Community Development has determined that the project is a Class 3 Categorical Exemption for the purposes of CEQA; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify the denial of said conditional use permit: 1. That the Planning Commission determined there is a compelling governmental interest in denying the project because the encroachment of the church into the residential area would be out of character with the neighborhood. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That Conditional Use Permit 02-25 is hereby denied for reasons stated above. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on the 17th day of December, 2002, by the following vote, to wit: AYES: CAMPBELL, JONATHAN, LOPEZ, FINERTY NOES: TSCHOPP ABSENT: NONE ABSTAIN: NONE / SONIA CAMPBELL, Vice Chairperson 1 J PHILIP DRELL, Secretary' l Palm Desert PI nning Commission
