HomeMy WebLinkAboutRes No 2182PLANNING COMMISSION RESOLUTION NO. 2182 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF AN ENVIRONMENTAL ASSESSMENT AND A MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT TO ALLOW 1) CONSTRUCTION OF THE VISITOR CENTER 3 MILE LOOP TRAIL ON APPROXIMATELY 260 ACRES EAST OF STATE HIGHWAY 74 AND SOUTH OF THE SANTA ROSA AND SAN JACINTO MOUNTAINS NATIONAL MONUMENT VISITOR CENTER. MORE PARTICULARLY DESCRIBED AS THE EASTERN PORTION OF SECTION 7, TOWNSHIP 6 SOUTH, RANGE 6 EAST,2) A CHANGE OF ZONE FROM HILLSIDE PLANNED RESIDENTIAL, DRAINAGE TO OPEN SPACE, DRAINAGE FOR 18 ACRES ADJACENT TO HOMME/ADAMS PARK. MORE PARTICULARLY DESCRIBED AS APNs 628-030-001 THROUGH 628-030-004 AND 3) A PRECISE PLAN AMENDMENT TO ALLOW CONSTRUCTION OF A TRAIL SYSTEM LINKING HOMME/ADAMS PARK AND CAHUILLA HILLS PARK LOCATED WEST OF THE PALM VALLEY STORM CHANNEL GENERALLY BETWEEN THRUSH ROAD AND GREENE WAY. MORE PARTICULARLY DESCRIBED AS: APNs 628-020-020 THROUGH 027, 628-030-001 THROUGH 004, 628-030-012, 628-030-013, 628-050-002, 628-05-018, 628-150-001, 628-260-058 AND 640-180-008. ALSO TO INCORPORATE 18 ACRES ADJACENT TO HOMME/ADAMS PARK INTO THE PARK. MORE PARTICULARLY DESCRIBED AS APNs 628-030-001 THROUGH 628-030-004 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 21 ' day of January, 2003, hold a duly noticed public hearing to consider a request by the City of Palm Desert for the above mentioned project; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation ofthe California Environmental Quality Act, Resolution No. 02-60," in that the Director of Community Development has determined that, with mitigation measures implemented, the project will have not have an adverse impact on the environment and a Mitigated Negative Declaration has been prepared; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify recommending approval of the project to the City Council: 1. The design of the precise plan will not substantially depreciate property values nor be materially injurious to the properties or improvements in the r.�. 2. The precise plan will not unreasonably interfere with the use and enjoyment of the property in the vicinity by the occupants thereof for lawful purposes. PLANNING COMMISSION RESOLUTION NO. 2182 3. The precise plan will not endanger the public peace, health, safety, or general welfare. 4. The proposed zoning of O.S., D is consistent with the existing land use. 5. The proposed zoning will not depreciate property values, restrict the lawful use of adjacent properties or threaten the public health, safety of general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That Change of Zone 03-01 and Precise Plan 01-01 A are hereby recommended to the City Council, subject to conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 21 ' day of January, 2003, by the following vote, to wit: AYES: CAMPBELL, JONATHAN, TSCHOPP, FINERTY NOES: NONE ABSENT: LOPEZ ABSTAIN: NONE ST: PHILIP DRELL, ecretary Palm Desert Planning Commission 2 CINDY FINERTY, Chairperson PLANNING COMMISSION RESOLUTION NO. 2182 CONDITIONS OF APPROVAL CASE NOS. This project shall be subject to all mitigation measures identified in the approved Mitigated Negative Declaration of Environmental Impact. 3
