A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY
COUNCIL APPROVAL OF A GENERAL PLAN AMENDMENT AND
CHANGE OF ZONE FROM MEDIUM DENSITY RESIDENTIAL PR-5
N.S.P. TO OFFICE PROFESSIONAL AND A PARCEL MAP WAIVER
TO RECONFIGURE TWO LOTS FRONTING ON VILLAGE COURT
ALL LOCATED ON PROPERTY AT THE NORTHERLY END OF
EMBASSY SUITE, 74-700 HIGHWAY 1 1 1.
CASE NOS. GPA 03-06, C/Z 03-09 AND PMW 03-05
WHEREAS, the Planning Commission of the City of Palm Desert, California, did
on the 7th day of October, 2003, hold a duly noticed public hearing to consider the
request of SCHMID INVESTMENTS L.P. for approval of the above described project;
and
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 02-60", in that the Director of Community Development has
determined that the project is a Class 32 Categorical Exemption and no further
environmental review is necessary ; and
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments, if any, of all persons desiring to be heard, said Planning Commission
did find the following facts and reasons to justify its actions, as described below:
General Plan Amendment / Change of Zone:
1. The office professional designation / zoning at the proposed location
represents a logical extension of the existing O.P. designation / zoning to
the north and east.
2. The O.P. land use designation / zoning allows for adequate design buffers
to assure compatibility with adjacent land uses.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the Planning Commission in this case.
2. That the Planning Commission does hereby recommend approval to the
City Council Case Nos. GPA 03-06 Exhibit "A", C/Z 03-09 Exhibit "B",
and PMW 03-05 on file in the Department of Community Development.

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 7th, day of October, 2003, by the following vote,
to wit:

NOES: NONE
ABSENT: NONE
ABSTAIN: NONE
