HomeMy WebLinkAboutRes No 2266PLANNING COMMISSION RESOLUTION NO. 2266 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DELETING CONDITIONS 10 AND 12 OF PLANNING COMMISSION RESOLUTION 1770 AND CONDITIONS 2 AND 3 OF PLANNING COMMISSION RESOLUTION NO. 1737 TERMINATING SPECIAL APPROVALS AND REQUIREMENTS FOR OFFICE USE, AT 75-100 MEDITERRANEAN AND PARKING AT 75-071 ST. CHARLES PLACE. CASE NOS. PP 90-12 AND PP 96-6 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 8th day of April, 1996, grant approval of expanded office use for a mixed industrial/office building 75-100 Mediterranean with the condition that 12 offsite parking spaces be reserved to serve the subject building at a second property located at 75-071 St. Charles Place; and WHEREAS, the owner of said building at 75-100 Mediterranean wishes to terminate the special land use approvals granted by the Planning Commission Resolution No. 1737 and restore the use and improvements consistent with the existing on -site parking supply which eliminates the need for the special parking requirements placed on the property on 75-071 St. Charles Place; and WHEREAS, the Planning Commission did find the following facts and reasons to exist to justify the deletion of the requested conditions of approval: 1. The applicant has agreed to terminate the intensive office use and physically restore the building to a condition conforming to the on -site parking. 2. The requirement for offsite parking at 75-071 St. Charles Place will no longer be necessary. 3. The deletion of the special conditions will not endanger the public peace, health, safety, or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Planning Commission in this case. PLANNING COMMISSION RESOLUTION NO. 2266 2. Condition Nos. 10 and 12 of Planning Commission Resolution 1770 and Condition Nos. 2 and 3 of Planning Commission Resolution 1737 are hereby deleted, subject to the attached conditions. PP 90-12 AND PP 96-06 Department of Community Development: 1. That all conditions included in Planning Commission Resolution Nos. 1737 and 1770 remain in effect with the exception of those noted in this resolution. 2. Within 30 days of the approval of this resolution at least 4,000 sq. ft. of office space at 75-100 Mediterranean shall be cleared of all office related tenant improvements. 3. Intensity of use in the remaining office space shall be consistent with the existing 29-space parking lot. 4. Prior to a Certificate of Use being issued for any new tenant in the building at 75- 100 Mediterranean, applicant, future owner or tenant shall submit for approval and shall implement tenant improvement plans restoring the remaining area devoted to office use to a condition consistent with the 29 space parking lot supply. //
