A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, DENYING A PRECISE PLAN TO
CONSTRUCT A 5,250 SQUARE FOOT BUILDING AT 73-168 HIGHWAY
111
CASE NO. PP 04-07
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 20U'
day of July, 2004, hold a duly noticed public hearing to a consider a request by ALLAN ZYLSTRA for
the above mentioned; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find
the following facts and reasons to exist to justify denying said precise plan:
FINDINGS FOR DENIAL OF A PRECISE PLAN:
1. The precise plan does not comply with the off-street parking requirements of Section
25.58.310 of the Zoning Ordinance because the project is 12 parking spaces short of
the 21 required parking spaces.
2. The precise plan will not implement the goals and objectives of the General Plan.
3. The design of the precise plan could depreciate property values in the vicinity, or be
materially injurious to properties or improvements in the vicinity.
4. The precise plan would unreasonably interfere with the use and enjoyment of the
property in the vicinity because of the shortage of parking spaces provided.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm
Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings of the
Planning Commission in this case.
2. That Precise Plan 04-07 is hereby denied.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 3rd day of August 2004, by the following vote, to wit:
AYES: CAMPBELL, FINERTY, LOPEZ, TSCHOPP, JONATHAN
NOES: NONE
ABSENT: NONE
ABSTAIN: NONE
