HomeMy WebLinkAboutRes No 2304PLANNING COMMISSION RESOLUTION NO. 2304 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A PARCEL MAP CONSOLIDATING SIX LOTS INTO TWO LOTS LOCATED ON THE SOUTH SIDE OF FRED WARING DRIVE 260 FEET EAST OF SAN ANSELMO AVENUE, 73-321 FRED WARING DRIVE. CASE NO. TPM 33067 (RELATED TO PP/CUP 04-08) WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 19th day of October, 2004, hold a duly noticed public hearing which was continued to November 16, 2004, to consider the request of FRED WARING PROFESSIONAL PLAZA for approval of the above described project; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 04-106," in that the Director of Community Development has determined that the project was reviewed as part of PP/CUP 04-08 and is a Class 32 Categorical Exemption; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify approval of the parcel map: PARCEL MAP 1. That the proposed map is consistent with applicable general plan. 2. That the design or improvement of the proposed map is consistent with applicable general and specific plans. 3. That the site is physically suitable for the type of development. 4. That the site is physically suitable for the proposed density of development. 5. That the design of the parcel map or the proposed improvements is not likely to cause substantial environmental damage or substantially and avoidably injure fish and wildlife or their habitat. 6. That the design of the subdivision or the type of improvements is not likely to cause serious public health problems. 7. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. PLANNING COMMISSION RESOLUTION NO. 2304 8. That the size of the Tots created is sufficient so as to not negatively impact any future passive or natural heating or cooling opportunities in the subdivision. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Planning Commission in this case. 2. That the Planning Commission does hereby approve TPM 33068 on file in the Department of Community Development, subject to conditions. TPM 33068 Department of Community Development: 1. The development of the property shall conform substantially with exhibits on file with the Department of Community Development, as modified by the following conditions. 2. Recordation of the map shall occur within two years of the date of this approval unless an extension of time is granted; otherwise, said approval shall become null, void and of no effect whatsoever. 3. The development of the property described herein shall be subject to restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Development of Tots contained within the subject map shall be subject to the conditions of PP/CUP 04-08. Department of Public Works 1. There shall be recorded on the map a reciprocal easement for parking, access, drainage, and use of trash enclosure. 2. All conditions of PP 04-08 dated April 30, 2004, shall apply to parcel map. // 3
