A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE
PERMIT TO ALLOW A UNIVERSITY OF PHOENIX SATELLITE
CAMPUS FOR UNDERGRADUATE AND POST -GRADUATE
EDUCATION LOCATED AT 75-153 MERLE DRIVE.
CASE NO. CUP 04-20
WHEREAS, the Planning Commission of the City of Palm Desert, California, did
on the 18th day of January, 2005, hold a duly noticed public hearing to consider the
request by APOLLO GROUP, INC./HARLAN LINDHOLM for approval of the above noted;
and
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedure for Implementation of the California Environmental Quality Act",
Resolution No. 04-106, in that the Director of Community Development has determined
that the project is a Class 1 Categorical Exemption; and
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said Planning
Commission did find the following facts and reasons to exist to justify approval of the
said request:
1. That the proposed location for the University of Phoenix satellite campus
is compatible to the surrounding businesses.
2. That the proposed university and the conditions under which it will be
operated and maintained will not be detrimental to the public health,
safety or general welfare, or be materially injurious to properties in the
area.
3. That the proposed conditional use will comply with each of the applicable
provisions of this title.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings of
the Commission in this case.
2. That approval of Conditional Use Permit 04-20 is hereby granted, subject to
conditions attached.

PASSED, APPROVED AND ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 18`h day of January, 2005, by the following vote, to
wit:

CONDITIONS OF APPROVAL
CASE NO. CUP 04-20
Department of Community Development:
1. The development of the property shall conform substantially with exhibits on file
with the Department of Community Development, as modified by the following
conditions.
2. The applicant shall obtain any necessary permits from and/or clearances from
the following agencies:
City Fire Marshal
City Building and Safety Department
3. The use shall be limited to one (1) faculty member and six (6) employees from
8:00 a.m. to 5:00 p.m. Monday through Friday.
4. Class size shall be limited to a maximum of twelve (12) students.
Class schedule shall be limited to one (1) class between 8:00 a.m. and 5:00 p.m.
Monday through Friday and three (3) classes between 6:00 p.m. and 10:00 p.m.
Monday through Friday. If need arises, Saturday classes shall be reviewed by
the Director of Community Development. If the additional classes are deemed an
expansion of the conditional use permit, a new public hearing will be held.
6. Any proposed change of this conditional use permit will require an amendment,
which will result in a new public hearing.
7. In accordance with Palm Desert Municipal Code Section 3.44, the project shall
be subject to Transportation Uniform Mitigation Fees (TUMF).
