HomeMy WebLinkAboutRes No 2352PLANNING COMMISSION RESOLUTION NO. 2352 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A TENTATIVE TRACT MAP SUBDIVIDING SEVEN (7) CUSTOM LOTS WITHIN THE CANYONS AT BIGHORN INTO SIX (6) CUSTOM LOTS. SUBJECT PROPERTY IS LOCATED AT 1006-1018 CAUHILLA FALLS (APN: 652-330-001, 652-330-002, 652-330-003, 652-330-017, 652-320-017, 652-320-002, 652-320-003) CASE NO. TT33854 WHEREAS, the Planning Commission of the City of Paim Desert, California, did on the 20Th day of September, 2005, hold a duly noticed public heanng to consider the request by Bighom Development, LLC, for approval of the above noted; and WHEREAS, said application has complied with the requirements of the "City of Paim Desert Procedure for ImpIementation of the Califomia Environmental Quality Act", Resolution No. 05-52, in that the Director of Community Development has determined that this project is a Class 5 categorical exemption for the purposes of CEQA; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the foliowing facts and reasons to exist to justify approval of the said request: 1. The proposed tract map is consistent with the proposed general plan designation of Iow density residential. 2. That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. 3. That the site is physicafly suitable for the type of development. 4. That the site is physically suitable for the proposed density of development. 5. The design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantial and avoidable injury to fish, wildlife or their habitat. 6. The design of the subdivision will be in compliance with applicable health, safety and building codes. The site can be served by respective utilities, will provide adequate traffic circulation and is designed in compliance with all city codes. 7. All subdivision improvements will not conflict with any public easements. - PLANNING COMMISSION RESOLUTION NO. 2352 8. The project meets alt code requirements. The design of the subdMsion wUl not impact solar access to adjacent properties or the subject property. All single-family homes shall be reviewed and approved by the City prior to construction. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Paim Desert, California, as foliows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That approval of Tentative Tract Map No. 33854 is hereby granted, subject to conditions attached. SCHOPP, Chairp PLANNING COMMISSION RESOLUTION NO. 2352 CONDITIONS OF APPROVAL CASE NO. TT 33854 Department of Community Development: 1. The development of the property shall conform substantially with exhibits on file with the department of community development, as modified by the foliowing cond itions. 2. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to alt municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shafl first obtain permits and/or clearance from the following agencies: Coachella Valley Water District Paim Desert Architectural Commission City Fire Marshal Public Works Department Sunhine Transit Authority Evidence of said permit or chearance from the above agencies shall be presented to the department of buihding and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Ahl sidewaik plans shahl be reviewed and approved by the Department of Pubhic Works. 6. Ahl onsite utihities shall be underground. 7. Apphicant agrees to maintain the landscaping required to be installed pursuant to these conditions. Applicant wihl enter into an agreement to maintain said landscaping for the hife of the project, which agreement shahl be notanzed and which agreement shahl be recorded. It is the specific intent of the parties that this 3 PLANNING COMMISSION RESOLUTION NO. 2352 condition and agreement run with the land and bind successors and assigns. The final Iandscape plan shall include a Iong-term maintenance program specifying among other matters appropriate watering times, fertilization and pnining for vanous times of the year for the specific matenais to be planted, as well as penodic replacement of materials. All to be consistent with the Property Maintenance Ordinance (Ordinance No. 801) and the approved Iandscape plan. 8. The project shall be subject to aI applicable fees at time of issuance of building permits including, but not Iimited to, Art in Public Places, Fringe - Toed Lizard, TUMF, School Mitigation and Housing Mitigation fees. Department of Public Works: GENERAL Landscaping maintenance of any common areas shafl be provided by the homeowners association. Landscape treatment shall be water efficient in nature and shall be in accordance with the City of Paim Desert Iandscape design standards. Applicant shafl be responsible for executing a declaration of Conditions, Covenants and Restrictions, which declaration shall be approved by the City of Paim Desert and recorded with the County Recorder. The declaration shall specify: (a) the applicant shall oversee the formation of a property owners association; (b) the property owners association shall be formed prior to the recordation of the Map; and (c) the aforementioned Iandscaping shall be the responsibikty of the property owners association. Landscaping plans shall be submitted for review simultaneously with grading plans. 2. A complete preliminary soils investigation, conducted by a registered solis engineer, shall be submitted to, and approved by, the Department of Public Works prior to the ssuance of a grading penmt. BONDS AND FEES 3. A standard inspection fee shall be paid prior to issuance of grading permits. DESIGN PLANS 4. Complete grading and improvement plans and specifications on electronic files shall be submitted to the Director of Public Works for checking and approval prior to issuance of any permits. 4 PLANNING COMMISSION RESOLUTION NO. 2352 5. mprovement plans for utillty systems shaU be approved by the respective provider or service districts with "as -built" plans submitted to the Department of PubUc Works prior to project final. Utility easements shall be relocated to accommodate new lot lines. 6. Complete tract map shall be submitted as required by ordinance to the Director of Public Works for checking and approval prior to the issuance of any permits. 7. Pad elevations, as shown on the tentative map are subject to review and modification in accordance with Chapter 26 of the Paim Desert Municipal Code. REQUIRED CONSTRUCTION 8. All public and private improvements shall be inspected by the Department of Public Works. 9. Applicant shall comply with provlsions of Paim Desert Municipal Code Section 24.12, Fugitive Dust Control as well as Section 24.20, Stormwater Management and Discharge Control. 10. Prior to the start of construction, the applicant shall submit satisfactory evidence to the Director of Public Works of intended compliance with the National Pollutant Discharge Elimination System (NPDES) General Construction Permit for storm water discharges associated with construction. Developer must contact Riverside County Flood Control District for informational materials. Riverside County Fire Department: All buildings shall be accessible by an all-weather roadway extending to within 150' of all portions of the extenor walis of the first story. The roadway shall be not Iess than 24' of unobstructed width and 1 3'6" of vertical clearance. Where parailel parking is allowed, the roadway shall be 36' wide with parking on both sides, 32' wide with parking on one side. Dead-end roads in excess of 150' shall be provided with a minimum 45' radius turn around (55' in industrial developments). 2. The required water system including fire hydrants shall be installed and accepted by the appropriate water agency prior to any combustible building material being placed on an individual lot. Three sets of water plans are to be submitted to the Fire Marshal Office. 5 PLANNING COMMISSION RESOLUTION NO. 2352 3. The applicant or developer shall prepare and submit to the Fire Marshal Office for approval, a site plan designating required fire lanes with appropriate lane painting and signs. 4. Blue dot retro-reflectors shall be placed in the street eight (8") from centerline to the side that the fire hydrant is on, to identify hydrant Iocations. /1 6
