HomeMy WebLinkAboutRes No 2353PLANNING COMMISSION RESOLUTION NO. 2353 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A TENTATIVE PARCEL MAP SUBDIVIDING 4.85-ACRE PARCEL INTO FOUR (4) PARCELS. THE PROPERTY IS LOCATED AT 73-770 DINAH SHORE DRIVE. (APN: 653- 250-031) CASE NO. TPM 33855 WHEREAS, the Planning Commission of the City of Paim Desert, Califomia, did on the 20TH day of September, 2005, hold a duly noticed public heanng to consider the request by Spyder Business Center, LLC, for approval of the above noted; and WHEREAS, said application has complied with the requirements of the "City of Paim Desert Procedure for ImpIementation of the Califomia Environmental Quality Act", Resolution No. 05-52, in that the Director of Community Development has determined that this project is a Class 15 categorical exemption for the purposes of CEQA; and WHEREAS, at said public hearing, upon hearing and considenng all testimony and arguments, if any, of aH interested persons desiring to be heard, said Planning Commission did find the foliowing facts and reasons to exist to justify approval of the said request: 1. The proposed parcel map is consistent with the proposed general plan designation of Iow density residential. 2. That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. 3. That the site is physically suitable for the type of development. 4. That the site is physically suitable for the proposed density of development. 5. The design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantial and avoidable injury to fish, wildlife or their habitat. 6. The design of the subdivision will be in compliance with applicable health, safety and building codes. The site can be served by respective utilities, will provide adequate traffic circulation and is designed in compliance with all city codes. 7. All subdivision improvements will not conflict with any public easements. 8. The project meets all code requirements. The design of the subdivision will not impact solar access to adjacent properties or the subject property. All single- family homes shall be reviewed and approved by the City prior to construction. PLANNING COMMISSION RESOLUTION NO. 2353 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Paim Desert, California, as foliows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That approval of Tentative Parcel Map No. 33855 is hereby granted, subject to conditions attached. TSCHOPP, Chairper .n 2 PLANNING COMMISSION RESOLUTION NO. 2353 CONDITIONS OF APPROVAL CASE NO. TT 33855 Department of Community Development: 1. All conditions of approval for Case No. PP 05-1 3, approved by Planning Commission Resolution No. 2350 shall apply to the above noted project. Department of Public Works: PARCEL MAP CONDITIONS 1. The map shall record a reciprocal easement for parking, access, drainage, and use of trash enclosure as applicable. 1/ 3
